Hello did some searching on the site about the rear brake locking, BUT I think my scenario is slightly different.
1.push bike out of garage - ok
2.ride short distance(WITHOUT using the brake pedal).
3.rear wheel on stopping, solid.
4.wait until cools, wheel will unlock but ridden further will create same scenario as above.
5.rear caliper serviced(boot,bearings,pads) - still the same
any help greatly appreciated

Welcome Dave - Assuming its a 650 GS you've got.....

You've put this in the wrong section to get a response.... I'll get it shifted for you :beerjug:

I had a similar issue with a scooter a while back.

The adjuster on the brake lever was adjusted too far in and wasn't gettin full return at the master cylinder. This dragged the brakes slightly, and as the fluid heats up and expands it then swells in the caliper and locks the brakes on.

Your issue is definately down to the brake sticking on slightly or the piston not returning in the master cylinder.

Cause could be down to poor adjustment, overfilling or knackered master cylinder IMHO.
