Well, as some of you know I've not been about much, change of job etc not really giving me much time to ride...

But what really confuses me, is I've still got the HP, sat out under a cover and not ridden for about a year!

To cut a long story short I stopped paying for it well over a year ago, mainly because of financial reasons and also being totally pissed with BM's attitude towards the fecked forks amongst a few other issues. They got pissy when I told them, 'bollox I ain't paying for it any longer'!

They sent out some shitty letters, gave me a few sharp phone calls, issued me a default (like that bothered me) and sent me a few more letters etc. Not much really gets to me in this life, especially shit like this! I just told them to stop giving me shit and come and pick up this piece of shit!

Well, the last word from them (on the phone) was about 12 months ago, they were gonna pick it up?

Guess what...... I've still got it???

I can't actually remember whether or not I've paid more than a third off the finance or not...:nenau

Anybody else experienced anything similar?

I'm with Mr Hall - I have never been in the position not to be able to pay a finance deal so wouldn't know, but you will be screwed if you try to sell it and the buyer does a HPI check.

All though you may think you were being very valiant protesting your bikes build quality, I really don't think you have done yourself any favours.
 
They'll get round to it eventually, I think they've lots of defaults on credit agreements to sort out. You should eventually get a few snotty letters either from them or a solicitor asking for return of the bike and for you to sign an agreement that you're liable for any shortfall on the balance of the finance due. Depending what your financial position is and whether you care about court judgments against you or not this might be worth agreeing to.

If you don't do that they'll probably end up taking you to court, getting a return of goods order, taking the bike, auctioning it and you'll end up with a CCJ for the balance due under the agreement less sale proceeds, plus interests plus costs...

If your form of telling them to stop the shit and pick up the bike can be interpreted as a voluntary termination it does limit the liability a bit under certain circumstances.

Alternatively try talking to them again if you're bothered about the cost, it might save a few quid in the long run.

You're obviously lucky enough not to find yourself in a financial 'downer', and on the flip side, probably wouldn't have big enough balls to make a stand against 'the machine' for not being happy with a sub-standard product....:censor:

If I can just interrupt the banter and general abuse :) for a moment. What you think might have been a VT with you not owing them anything might not turn out to be that, depending on the timing and the amounts owed. They've got 6 years from the default to do anything about it and depending on your circumstances not paying them anything might not be in your hands - bailiffs, bankruptcy, attachment of earnings, charging orders etc - are all things they can do.

On the other hand if VT'd properly they are extremely slow, I (legitimately) VT'd a BMW car a few years ago, I had to push them to arrange the return and eventually told them I would return it to a specific dealer on a specific date. If I'd had space to store it I probably would still have it.

To give you a flavour of what you can expect . Some asshole in London managed to get a credit line from Littlewoods ( second bunch of asshole) and went shopping using my name and details , but using an London address for delivery . Next thing I know, I received a bailiffs letter demanding payment for goods I didn't purchase . The on going saga lasted for 3 months , by the end of which the bailiffs received a bill for £250 ( that was more than they were supposed to recover ) for solicitors fee's and then letting them know, that I would send the bailiffs in to recover the fee if they don't pay.
In the end I received a letter of apology from Littlewoods and the recovery agency and compensated for the inconvenience.
Why don't you sell the bike , strait forward. Inform BMW you have a buyer , buyer pays BMW finance . My previous purchase had finance on it , seller didn't want the bike , my dealing was with BMW Finance . The seller just signed the V5 and it was a good deal :D....

They probably just blacklisted you and wrote the debt off.

That's what I'm thinking?

No, not tried to get any finance, don't bloody want any either!

I fell out with my bank over bank charges, we agreed to disagree over the monies owed, I paid them way less than I actually owed, they accepted then closed my account (pays to sit out these bastards!). I'm now self employed with a new bank account (very little in it) and another savings account in my underpant drawer...:D Maybe BM finance will put an attach of earnings to my pant drawer..:confused:

Anyway, for them to take me to court will probably cost more than the 'sauce' is worth.....
 
Dirty Dog your name is appropriate why not pay your bills or sell the bike and settle the debt. Its acts like yours that cause trouble for ethical people.

You can blame it on the forks but everyone else is happy.

I visit customers businesses at 6 in the morning with a baseball bat and recover the goods. Lucky you dont owe me!!!

Go buy the book "who moved my cheese" get your running shoes on and get out of debt!
