Morning all
Just aquick comment on the unresolved DMMO (Byway) claim...I understand from colleagues in DCC that they have written to the claimants to explain that as a result of the Winchester Case, the claim will not be pursued. Although I have no official notice of this, I think we can assume that the route is a Restricted Byway.
regards
Mike

Subject: RE: Incident at Baslow/Biker contact.
I would endorse Chris Mitchell’s comments about the official status of this road and also agree with Mike Rhodes’ that the absence of signage for many years has meant the status has depended on hearsay and the locked gates.
My first acquaintance with this route was about 15 years ago, when 4x4 driver friends told me it had a TRO on it. There were no RTA signs to tell motorists this, but the gate at the northern end was locked and at the southern end just out of Baslow there was a gate barricaded with large boulders. So 4x4s were physically blocked from using it but there was a way through for motor-cycles (and horses), hence, I assume they considered it was OK for them to use it.
There are now RB signs at each end, but while there is an unresolved DMMO claim it is understandable that bikers will still consider they are OK using it. The database Chris has mentioned is a combined GLASS/TRF facility, so members of both organisations will know the state of affairs, but still leaves a lot of drivers who don’t know.
