but done nothing since - and they still not pressing for it - the gloves thing too - theyd never rent a scooter again if the flip flop thing happened
also the using hard shoulder when busy - they were supposed to clamp down on that but friend that lives there says local cops say its tolerated cos its safer than filtering

a couple of points of order here.
Let's start with the last one. As of 1st Jan 2026 motorbikes
are permitted to use the hard shoulder in slow or stationary traffic up to a speed of 30Km/h.
Open face helmets are not banned.....yet.... However, they must be homologated to ECE 20.06 std. In due course these helmets are due be banned on open highways and interurban roads. They will likely remain legal in "town" for some time to come, though. These are not recommended for riding on highways or interurban roads.
Gloves. Interesting one because it
is a requirement to wear them (and you'd be stupid not to on a highway anyway), but it is actually not sanctionable.
Flip-flops. Actually, you're right, there is no rule or law that prohibits you from riding with them on. However it will still potentially earn you an €80 fine if the officer decides that it impedes safe control of the bike. So you
may not get stopped if you're riding a scooter because most of them do not have foot controls (some do), but you will be stopped on a motorbike with gears and a brake pedal if you're wearing flip-flops.
Lastly there is probably something many will not know: In Spain the "Seguridad Social" (NHS equiv) can, and often do, sue insurance companies (and/or individuals) for medical costs. As with all things legal it can soon become a maze, but if negligence (on your part) can be proved, such as not wearing recommended safety equipment (or wearing the wrong type i.e not homologated), then you have to ask yourself, is it really worth it?
