Garmin Unit and Software locking issue

Hello

Wonder if anyone can help.

A couple of months ago I sold my Garmin GPS60CS unit onto someone.

I kept the existing software, Europe City Navigator and OS UK for myself to use on any future units.

It would appear the owner cannot use the Unit to download any software he has as I have the unit registered to myself. Easy you say, unregister the unit. Yup, but it would appear I have to unregister the software too, and hand to the new owner, something I am unwilling to do unless he pays for it.

This is the email received from Garmin...

Sorry to contact you out of the blue but we need your help regarding a GPSMAP 60CS which you are the registered owner of. I believe you have recently sold this unit on.
The new owner has contacted us because he has bought a Topo DVD and wants to register and load it. However there is a problem which we need your help with please.

You have the unit and 2 lots of mapping registered in your name. If you sell a unit the mapping has to go with it because the mapping is locked to the unit and can't be removed or unlocked from the unit.
I understand that you probably weren't aware of this when you sold it.

The new owner can't register the unit in his name or use his new Topo without you giving us permission to re-register the unit and both lots of mapping in his name. As you had Topo as well we can arrange for him to use your Topo code and he can give you his Topo code which is still unregistered in return so you could use it on any new unit you buy in the future.

I'm happy to answer any questions you have. The new owner is keen to try and get this sorted out ASAP so he can get out and use the GPS.

My Reply

I am willing to unregister my old GPS.

However I bought 2 additional lots of Topo over and above the GPS at an additional cost of approximately £300, not cheap you would have to admit. The Eurpoe City mapping and the Uk OS Mapping I am unwilling to unregister unless I can be guaranteed that I can use this software with any other Garmin GPS's. An alternative is that I am recompensed and Colin can use this.

I would also have to say that the software Colin has bought is completely different from the software I have.

Another alternative is that I take the gps back from Colin and fully refund him, and you fully refund him for the software.

I have to reiterate that this is a policy imposed by garmin that we were not aware and are now being punished for. Its a bit like buying a hi-fi and cds, and the hifi manufacturer saying that you cannot sell your hi-fi unless you sell your cds, because the person who buys the hifi cannnot play his own CDs, only the ones that comes with the hifi .

Therefore Garmin...why do you sell software separately from the units??

I want to resolve this quickly for Colins sake, but at the same time do not wish to be out of pocket, so Garmin if you can give me reassurances that the software I bought over and above the GPS can be used on future Garmin GPS's, then I am willing to swop codes. Otherwise I will sell the software with the relevant codes and move to another manufacturer.

Their subsequent reply....

The policy of locking software to a device and not being unable to unlock it is a policy of the companies that supply the mapping not a policy of Garmin. Therefore Garmin have no control over that policy and cannot change it. You did agree to this policy when you unlocked the mapping to your GPS by agreeing to the software license agreement.

If you don't agree to allow the software ownership to be transferred into Pauls name he will not be able to use any locked software on the unit. He will only be able to use pre-programmed memory cards.

Garmin sells software separately from the GPS units so that people can have a choice of what software they want to use on the GPS units.

As you suggest you can refund Colin for the unit and he can return the software he has bought to the retailers for a refund.

I do sympathise and I'm sorry that there is no easier way round this problem.

Incidently it is Garmin software.

Any ideas.

I think that it's reasonably well understood by most Garmin users on this forum that the mapping data is locked to a particular unit and cannot (now) be used on any other unit.

Maybe you didn't realise that, but when you sold the unit to your buyer, what you were doing was much like selling someone one half of a £50 for twenty-five quid. Yes, on the face of it it's what it's worth, but, in practice, once you split the two they both become worthless.

One way or another, you have to reunite the unit with its software.

I dont understand why they sell software separately.

Anyway, I have offered to buy the GPS unit back, or sell him the software...don't think I will be using them again.
