It is not always the case that europe demands specific controls but rather that a general principle is transposed into member states national law. The failure to transpose into national law is the offence that can be punished by a fine.
The transposition into national law is where overzealous domestic technocrats ( usually pressured by domestic lobby groups) can go beyond the broad outline objective required by europe and intoduce national legislation that uses a sledgehammer to crack a nut.
It would be interesting to find out what euro directive is allegedly demanding this action and what detail is contained within it.
