I would think it's because the liability issue would transfer to the after-market supplier, unless it was the fitting that was at fault. For example, if you alleged that the cause of your accident was a lack of control due to the incorrect fitting of Touratech bar risers (ie they came loose) then the dealer who fitted them would be answerable. If, however, you alleged it was the design of the risers that caused it, Touratech would be liable. If the parts were made by BMW, but not for that bike, the BMW dealer would be liable whatever the fault, as they weren't specified for that bike. BMW would probably wash their hands of the dealer too....
I stress that I'm not a lawyer (thank God), but that line of thinking seems to follow the 'logic' of what Black20vt was told....
