I would think it's because the liability issue would transfer to the after-market supplier, unless it was the fitting that was at fault. For example, if you alleged that the cause of your accident was a lack of control due to the incorrect fitting of Touratech bar risers (ie they came loose) then the dealer who fitted them would be answerable. If, however, you alleged it was the design of the risers that caused it, Touratech would be liable. If the parts were made by BMW, but not for that bike, the BMW dealer would be liable whatever the fault, as they weren't specified for that bike. BMW would probably wash their hands of the dealer too....

I stress that I'm not a lawyer (thank God), but that line of thinking seems to follow the 'logic' of what Black20vt was told....

First I'm not trying to defend my work,I don't think IT's need to be DEFEND,is very ovius,how much stronger,plus redundant,those clamps are,plus those bars are by far the best in the bussiness.

you need to remenber this words(BMW Statement on the QUOTE)
are comming from a company that is trying to restrict the use of cloting to BMW clothes only,(I check for the tread later)......and you think HARLEY trys to "corner"the market

liavility is a problem that I confront before,for example my bicycle rack is completelly impossible to sell,because of this issues,
who will be at fault if something happend(in this case is very ovius)so will never be produce,belive I try to make "waivers,release forms,those not matter"I will never make them.

but the bars that is a complete different story, I design them to out perform,out last anything,the BMW bars are not even close.
I have friends that use to bend one (BMW bar,a lot of money if you ad,and +,+)every 3 months,if not less,now they have the "fat-bars" for 18 months(since I start making them,),not one more problem,and belive is not like they stop riding or stop CrasHing,( I personally "drop my bikes at least 35 times,dirt and tarmac)this bars are design to "never let you down,"(no I don't have the ansi or snell or any other seal of aproval,because I spend all the capital in making sure they are as strong as the are).someday,hopefully.
even the bolts are coated with treat lock(inviromentally friendlly,at that)to avoid any complications , installation mistakes.or just carelessness .
look at this picture,do you see those 8 bolts????,just for testing porpuses I run the clamps only using TWO of them,they did not move, slide,nothing,I belive i have at least 3 times redundant factor(the bolts are the highes grade stainless bolts you can buy)(i do know other steels are stronger,but longevity is a important consideration.)

the thread that (I think) you are referring to was a spoof (joke) BMW press release about people riding BMW bikes with non-BMW clothing not being covered by product liability in accidents. I KNOW product liability is no joke - but that one was! (I've just been looking for the thread, but can't find it...)

OPSSssssss,you see I'm such a GEEK I just belive what people tell me,I need to admite that was a very elaborate,really nicelly done piece of fiction.

anyway that SPOOF kind of summs their atitute,arrogant ,but mediocre,at best(that do you spect from a company run by accountants and lawyers)
