This takes a wee bit of explaining.

A few years ago, I was packing the bike up to go up to Johnny Oonyak's Skye do. We live in a tenement flat so the bike was double parked next to my old Accord. When I came down after one trip, there was a ticket taped to the tank. Bastard! I was absolutely beilin'!

Anyway, I appealed the ticket and it went as far as the parking adjudicator. He agreed with me and the ticket was cancelled. The reasons given were that (in so many words)' the parking regs applied only to the demarcated areas of the roadway: yellow lines, demarcated parking areas for residents, pay bays etc. The powers of the attendants did not extend to the roadway which could only be policed by the Polis themselves.

Anyway. Last December, I arranged to meet the boss in town to buy her Xmas prezzie. We arranged to meet at John Lewis so I headed for St Andrew's Square where there are bike bays on the east side of the square. Mayhem of course. Choc a block with Xmas shoppers plus the east side of the square was like the Somme plus tram lines. So I parked on the pedestrian area on the south of the square, right next to the Polis box and in the push bike area. Reckoned that this was safest for pedestrians, the blind etc. off to get the wife her Barbour jacket. ("How much????? Jeez, they used to be £15 and you werenae allowed into some pubs wearing em!")

Anyway. Came out and there was a ticket stuck to the bike's windscreen. So, I appealed again on the grounds that the attendants were not empowered to issue tickets in such circs. Council rejected the first appeal quoting the Highway Code etc. so I went to further appeal and the letter arrived this morning. Appeal allowed! Yah beauty.

So, if you get done for pavement parking in Embra, drop me a PM and I'll send you the relevant PCN number to appeal on the grounds of precedent.
