Stain tune Exhaust

Have bought a Stain Tune Exhaust and I have never seen such a well made piece of equipment but as it has no Kite Mark is it legal to use it on road and if it passes an MOT as it is not at all loud does it remain illegal. I do not know what makes an exhaust illegal if it is not loud and does not increase performance by much and after speaking to Carol Nash their attitude is if it does not have a Kite mark it should not pass an MOT which makes it illegal.
I have never had an MOT station check the Kite mark on any exhaust so any advice would be appreciated

A Kitemark is the recognition that a piece of manufactured equipment meets a determined level of quality and product performance. Perhaps CN insist on quality products with which to modify your bike.

The Stain Tune Exhaust is far superior to anything BMW produce

i think the law changed on exhausts for MOTs to as long as it was no louder than the original equiment
