I've rejected my bike can anyone recommend a good solicitor .

Due to various issue's and poor response from bmw uk and they do not answer my questions in full and want to bodge my bike with washers and several other issues now with the bike not being not fit for purpose and no date of it being fixed because parts are on long term back order and its not useable I'v now rejected the bike and I'm going to take on BMW uk and the dealership.

Can anyone recommend a Good solicitor that has the balls to stand up to them.

Hi , I took them on over a different issue and won, be prepared ,I had a good solicitor but im in northern ireland,
 
Hi yep I'm very prepared the bike is going into storage at a cost ill expect them to cover and I'm buying another bike a multistrada so I'm not being fooked over by these big corp co's, I stood my ground with yell pages to a sum of £12k being returned 'i won' it was hard work doing all the research myself but will worth it in the end.
 
Most Decent solicitors will have a specialist in this field . Careful though as they do Promise the earth to begin with , then might settle with " this is the best we can get " . BMW will have loads of money to throw at it , and it is Brinkmanship . I got screwed by an ex Work partner over a dispute , they claimed they were owed £40000 , they were not !! 4 years later we settled out of court , they got £16000 but we had to pay costs of ......................................£165000 :eek: I'm still not over it . Thing is Life is short , It must be gutting to have bought something substandard , and I feel for you . Shame they won't just refund , but i see you have had it for 2 months , so it will perhaps be a bit tricky . Good luck

The thing is there seems to be quite a few issues with other lc bm owners which should be in your favor, Good luck
 
One word of caution...
(No, I'm not standing up for BMW - just stating information)
And I am very sorry that you have had such a bad ride with BMW.

The back order parts are most likely due to the floods in Germany.
This is outside bmws control.
If this is the main cause of your complaint, BMW are not held liable by causes outside their control ( I believe )

If you are referring to the"spacer" that is used to get the panniers to fit - you have to prove that the solution provided by BMW is not "fit for purpose" - so you need an engineers report to condemn the "fix" - such a report needs to be based on structural analysis etc, or could easily be thrown out by the judge.

Also, you must show evidence that you have given them adequate opportunities to fix the issues and that you have minimised your costs with relation to motorcycle storage.

Do check with a solicitor before you order that Ducati...
I've supported someone in a similar case against an LPG installer - we won, but it comes down to hard provable facts - rather than your ( for example ) personal feelings about how you've been treated or your feelings about an official BMW "fix" for an issue.

I suggest you read the Ducati Boards , as a ex Multi owner the BMW product makes the Italian one look like 1940's engineering. For example the pannels still do not fit at the front even after the new model update, I spent ages on this and in the end gave up, every Multi has pannel gaps on the front fairing, Ducati says there are not meant to be but they are ! Rear brake does not work ! Front forks rattle , No cruise control , Rough running down low , Poor fuel consumption , Bouncy front screen, Useless windscreen with loads of wind noise that will send you deaf. Drop the bike over at a standstill and break the bark busters, now the brake and clucth fluid containes reside on these so the bike is now un rideable from a small fall over on soft ground. Rear tail light assemble rattles and is poorly fitted.

Mate I bet you are the wrong guy to own a Ducati !
 
For the benefit of all the other potential WC buyers can you enlighten us as to the issues that you have encountered, especially those that make the bike 'not fit for purpose'.
Yes it might be a help if you posted all problems and bmw's response. Might hurry them up a bit JJH

Regarding the duc I've owned several so aware of issues and the bike I've seen is a pikes peak dripping in bling.

The issues I have with my bike.

1- The clutch is fooked and drags gearbox clunks thro changes.
2- rear pads are down to metal @ 3k
3- The rear drive gaitor is holed
4- The vario's don't fit because rear subframe is out of tolerance the dealers benhams told me to modify the vario's to fit as I was going to Austria 2 days after I got the vario's and so the vario's had the plastic brackets trimmed down (these unbolt so can be replaced) the dealer said they will sort out on return.

The bike had its first service at 700 miles than I went to Austria and did the remaining miles taking it to 3k on my return the bike went back to benhams they gave me a rt12 that they want back, they made a puma report and sent it last Saturday it took nearly a week for BMW to get back to them, they said yes to brake pads as long as bike has not done more than 4k so be aware ! yes to gaiter but its on long term back order, the clutch they have not replied because they don't no how to fix I presume so that's ongoing, the vario's they will not fix or replace and suggested fitting washers under pillion pegs this I feel this is poor they have not stated why they don't fit when the same panniers fitted other bikes, they do not no when it will be fixed either I have another holiday booked can't cancel as ill lose my money they said I can have a f700 gs to use but can't take out the uk !

My argument is I brought a r1200gs TE model TE standing for touring edition ready to take the fitting of vario panniers, so my bike is not fit for purpose nor is it of satisfactory quality, if they had agreed to sort the panniers out and let me use a bike for my trip than i would have been happy as the bike is good just tarnished now by poor customer service.

Sorry to hear of your issues. Although it would let BMW off the hook, why not just trade it in against the Ducati, as the legal fees will probably be more than the difference between cost new and trade in?:rob If BMW did agree to refund you in full, I'd be surprised if they'd cover your legal fees as well, unless you actually take them to court.

It will still have poorly aligned pannels , and the other issues. The Ducati is very engageing to ride , but in Australia is nealy $6,000 more expensive then the top of the range GS, and in my opinion not as good a bike as the GS. I had to start fixing the Italian from day one, I've yet to put a spanner on the GS except for adding bling.
 
you may want to consider ATE insurance....

if you get insurance then the underwriter will sell you a policy, if they don't your onto a hiding to nothing and that's a clear steer what will happen in court.

can I ask have you been out in the sun without a hat...? my recommendation have a sit down in the shade, big glass of water and really think hard about what your doing first....!

What do you suggest ! Get spanked by BMW for £15k and let em walk all over me ! I'm afraid its not going to happen to be able to earn £15k to pay for this bike meant I had to sell my sole to the devil so I'm deffo not letting them off the hook, ill seek some legal advice failing that I may get a better reaction if I load the bike on my trailer get some professional signs made up and park outside BMW uk than every other dealer, a different one everyday a bit of press in MCN and a blog on here and various other forums with pics parked outside dealers than hopefully someone should take note.

It's all a bit OTT but they need to accept responsibility rather than bury there heads in the sand.

good on you dave:thumby: looking at the gearbox thread i don't think it will be long before a few wc owners join you, also im sure, in fact i know the dealers look at these threads so lets see some of em stand up for there very loyal customers:rob

Fella I think you miss read things the TE is ready to accept panniers so there is no need to buy brackets and my vario panniers was brand new straight out the box and not s/h used, its the rear subframe that is out of tolerance thus the reason the panniers don't fit, we tried them on 2 other bikes one with no mods (they fitted fine) the other bike had to have washers under pillion pegs that the dealer had done to get to fit !

Like I said I'm happy to have my bike repaired after all when its usable its a cracking bike, but I want them to accept responsibility for there mistakes in producing a TE model bike that is not fit for purpose and not being of satisfactory quality.
