the NHTSA report on the fork failure #10409875 has been updated by NHTSA

The insurance company has stated that the determination of the incident IS NOT MY FAULT.
Any other updates please check the thread, as it is hard to keep up with all the threads on the internet about the incident.
Thanks

The insurance company do have a vested interest in it not being your fault. If they can blame BMW then they get out of paying.

Still waiting for the other info and photos, the other damage (bent fork leg and broken brace) is still not entirely consistent with the fork leg failure being the cause rather than a result of events that occurred before the leg broke.

For those who havn't had chance to keep up with thread just lifted off a response from page 24 reply no.354. Dont know whether it actually means anything yet

Was at BMW dealer yesterday, and asked service dept. about fork failure. They are aware of it, but have
not been told anything further from BMW according to them.
There should be a recall and replacement of all 2011 lower fork tubes, as there is less material where axle
bolts go through, than on previous model years.

Dealer
Dealer is Gengras BMW in East Hartford, CT. Did not say who he heard about problem from. - END QUOTE)

Gave up.. This was one of several reasons but I sold it, took the hit and won't be buying BMW again (until I can afford a k1600 as a second bike anyway!)

Bye all
