brake light problem

A mate of mine has an R1200gs, 06 plate (with servo). When we put a voltmeter on the rear brake light we found 2.83 volts going through it even though the brakes were not applied I.E no brake light should be on. so we cannot fit the topbox brake light kit because the topbox lights are on all the time.
Can anyone tell me why ?.
 
It's a canbus controlled system the switches communicate with the ECU then that turns on the brake light

incidentally it looks really cool with top box "side lights" and brake lights.
