new issue has come out - if exposed to temps above 55c then they give false readings, a closed car in summer can reach that so rendeing the thing useless.
 
The Govenment reasoning behind this is actually a bit more subtle than just purely a money 'maker', it was primarily considered because it will actually save them a considerable amount of costs in road side breathalising and taking people to court for drink driving offences. I believe the figure is somewhere near €20m per annum which could be better spent elsewhere.

The legislation is also very clever because it is almost the perfect 'un-arguable' situation, and it puts more pressure on drivers to think about what they are doing.

If you've had a drink and you don't test yourself and you get stopped and you're over, they take your licence away and fine you.
If you've had a drink and your over and you drive and get caught, they take your licence away and fine you heavily.
If you don't carry at least one unused in your vehicle they fine you.

It's been in force a couple of months now, and I believe the current stats on the reduction of offences is quite marked. ( Will it become Euro wide legislation?)

This legislation is also the forerunner of vehicle ignition cut off systems which France hopes to make compulsory in new vehicles with in the next 3-5years.
 
Was stopped in France very recently. No questions about high vis or breath testers or even if the sat nav had speed cameras activated.

Hi-vis only starts next January (2013). Breathalyzers although mandatory, are not fined until November, so no sense checking for them. Speed cameras are ok, as long as they don't show the exact location, but within 5 kilometers, like most smartphones and satnavs do nowadays for France. But if you've got a smartphone with satnav, cops are not allowed to inspect your phone due to privacy issues, they need to get a warrant.

No, they can not. They need a warrant to check a phone, it is not considered a searchable item since it is private. They can however check a " normal " GPS.

They had some posters up at the borders stating the types of devices that could be checked and phones were part of it.
 
The straight version of the law over here is that a Gendarme or the Municipal Police cannot search your car without due cause and must have the authority of a magistrate before doing so.
But you can be asked to produce all your paperwork, the breathalyser, hi-vis jackets inside the car etc etc.
However, beware, the customs police (douanes) can and do stop you anywhere on the French mainland and search your vehicle for drugs, illicit firearms, illegal immigrants,contraband tobacco/cigarettes and illegal radar detectors and satnavs that tell you where the speed cameras are.

There you go. Douane are the only ones allowed to search personal belongings, including phone and car, which Gendarmes and other cops are not allowed.

A gendarme who stops you and wants to search for whatever reason, needs to get a warrant, or call in the Customs people.
 
It is very much like over here, when they are doing a specific stop and search, the DVLA and Immigration are also present.

Just a quick update for you. M.Valls the minister responsible for transport has recently announced that no fines or PV (Process Verbal or caution) will be made for not having breathalisers, until March 2013. The reason for this is supply shortage and elevated prices being charged to get them at this time. The whole idea is also under review. I can not see that it will be abandoned altogether, but at the moment there is no panic to get them

Sunday 31st September and Monday 1st October, I rode all the way from Spain to France, Calais. I stopped every 100-150 miles to fill up with petrol and not one single petrol station was selling a breathalyser, plenty of hi-vis though. Even asked for them at cafe's but nobody knew about them or even cared. The only place I found selling them was on the ferry back to Dover. :rolleyes:
