Can you be done by a lone garda??

Don't pay the fine............... go to court and tell the Judge that you did have the phone in your hand but only because you were going to take a photo on the policeman smoking in a state vehicle.:rob

If the Police Officer can't take the phone to check it for activity or ant contact the phone company could YOU provide the proof for a court? Case solved :beer jug:

All the best

John

Your word against his, he wins Mide. :(

+1 :thumb

I used to love those clever little shits, no seat belt, speeding, litter out of the window, ya know, general run of the mill stuff, just my word against theirs ...

... I used to love a not guilty plea

I never lost a case :thumb2

:beerjug:
If they had just said "Sorry mate, you've got me bang to rights!"

I wouldn't have given them a ticket :nod

No offence intended, but if you were holding your mobile whilst driving then you should be man enough to take the penalty.
However, you have presumably not been issued a ticket, or as yet received a court summons. So you may be very lucky and not get anything nasty in the post. Unless you were foolish enough to cause upset with the Officer when he spoke to you about the matter.
I`ll be upfront, I`m with Micky, been a Cop for 36 years, still am, though never worked in the traffic department and never reported anyone for speeding. However, I always report anyone I find using a mobile whilst driving, unless they have a bloody good excuse, and also have yet to lose mobile phone case at Court, even as the only witness. But then I would only make a report if I was 100% certain that I had seen a mobile and would present the facts accordingly. Lets face it, an Officer is not going to stand up in Court unless he/she is 100% certain about what had been witnessed, as much as anything their Job/liberty would be at stake if perjury was committed. So why shouldn't the Court believe what the Officer is saying, if its just your word against the Police Officers account.
If it gets that far, by all means give it a run at Court, but be prepared to lose and get a good solicitor.

That would be thrown out of court :aidan ;)

Banana

I have the habit of eating a banana in the mornings on the way into work. I peel it and hold it while I drive. Can I be done for this?
Bf(nervous).

Apparently you can, "Road Traffic Act,1961 Part V Driving Offences, Sub section 52 Careless Driving".

Tropical fruit (bananas) that require peeling to enable them to be consumed must be pre-peeled if they are to be consumed whilst operating a mechanically propelled vehicle.

Failure to observe this section will result in a fine and/or prison sentence.

So there you have it.... don't act the monkey when your driving.

Mide is one of the lumpy jumper brigade.

:D:D:D,but maybe mide,jus take pain.

All I said was "Hi." After that I didn't speak another word. I wasn't asked any questions, he asked for my licence, went to his car, came back and just told I'd receive a fine and 2 points. He then lectured me and told me how to pull away and rejoin the traffic.

I've no interest in it going to court, I was merely wondering what the chances were that he will send the fine given that he was alone and has no proof. I wasn't speaking/texting, I was using the phone as gps, driving at 100km in the middle lane of a 3 lane motorway mid morning on Friday. Very little traffic. I will absolutely take the fine and points.

I guess I'm pissed off that I got stopped:blast I have a handsfree kit in the car and have had for 5 or 6 years so don't drive around on the phone!

It must be one of the new offences that one can get points for since 1st Jan:nenau

Bit of a problem there Gadget old chap. Mide is one of the lumpy jumper brigade. :D

Why, Thanks Aidan;) you talk so pretty:kissy2

Ahh well, If yer hadn't have been hogging the middle lane on an otherwise quiet motorway he wouldn't have stopped you ....

It's a 100km speed limit on the m50, and honestly, if I hadn't been checking to see if the upcoming junction was mine, he'd've got me for speeding:augie

The left lane is usually deserted in the Dublin area. Rode down from there today - the usual lane blockers until the M 7 & M 9 diverge. I think it hinges on the left lane being percieved as the "slow" lane rather than the default position. The law here don't appear to make it an issue.

... and as a result it is often the best position for smooth and safe progress.*
Leaving all the silly buggers competing for space in the other two lanes.
It's Lindas preferred lane. ;)

EDIT:
* and before it starts
Obviously taking into account Observation toward exits, on ramps, lane changers etc. etc. etc. :blagblah
