Outcome

After several discussions with 'customer service' at BMW and a fair deal of persistence BMW initially came back with an offer to pay for the parts (around £650). I suspect/hope that this was also due to a sympathetic word from my dealer. I still felt unhappy at the prospect of paying the labour so went back to Customer services and had a fairly lengthy discussion about the sale of goods act, how long it was 'reasonable' to expect a drive shaft to last, small claims court etc, this time they offered to pay 50% of the labour + parts but the dealer would need to resubmit the claim. When I spoke to the dealer he said he would absorb all the labour costs (i think partly because he was fed up with the whole thing) so in the end it came good. Very helpful to have a supportive dealer on side. Anyway thanks for all the input..... :thumb

Technically BMW GB could say no, as the warranty did expire and you did not avail yourself of their extended warranty option. However my experience is that they are a fair company. I would suggest you offer to pay 50% of the labour only. If you pay a contribution all the parts are warrantied for a year. If BMW GB pick up all the tab the parts are not warrantied, and knwoing the luck of sod they could fail again in 11 months.

Well done Nelsonkite and rightfully so.

I don't understand why would these new parts not be covered by a manufacturers warranty. Surely the parts still have to be fit for the purpose. I would presume these new parts would have at least a years warrantee whether you paid for them or not. It was not his fault that they broke and surely the manufacturer should have faith in its product. :nenau

Nice one Nelsonkite, glad to hear of the positive outcome.

Who exactly is your dealer? It sounds like the least you can do is give them a free plug for their generous assistance, and buy from them again in the future.

:thumb Nice one Pretsige :thumb

I know they read the forum so I'm glad you've named them...people spend ages slagging off dealers and it's nice to redress the balance sometimes.

Doesn't surprise me though....They're bloody good there :clap

PS If you don't mind, I'm going to copy this thread into the dealer's section as well
