Dented alloy- council claim or repair?

So…. Lovely ride out to Barmouth and back yesterday with my wife on the back. Shallow but sharp edged pothole stretching across the road coming back through Herefordshire. If I’d been on my own I’d have stood up and softened the blow but having a pillion saw to that…
It was a heck of a thump and I expected to pop the tyre but it is (visually) ok.
I have two new tyres ready to go on so that’s fine- I expect to have damaged the ply under the rubber. It’s holding pressure and there’s no wobble/ vibration.
I’m tempted to either sort it myself or get a wheel refurbisher to do it for me. I see it as having two options for the expense- one is to claim off the council for the refurb or just claim for a new wheel.

Thoughts on best option and does anyone know the cost for a refurb if I go that way?
 
Council claim.

It would be of benefit if ..
The pothole showed signs of being previously recorded such as spray paint around it.

And had it NOT been so full of water at the time you would have been much better equipped to take avoiding action. 🤭


They will deny the claim automatically, but persist, this is a purely cost saving move.

Try a claim on the council if you have pictures of the hole. You’ve nothing to lose.
 
Not the same but I claimed for a dented BMW car alloy off my council 2022. It went all the way to me issuing a small claims court summons. They folded 2 weeks before Court
I got loads of photos and all the repair logs for the section of the road from the Council via data protection requests (That took a few months). Their records were a mess
They just hide behind the section 58 defence. And they engaged a big name Liverpool firm of Solicitors, which probably cost more than the claim
I had the time to do this and it was very satisfying when they coughed up for the new wheel, and all my admin costs....twats they were
 
Pictures (including measurements ) and exact location help in a claim, also report the pot hole using the online site . There is info online as to a certain size and depth of the pothole at which the council will struggle to refuse the claim
 
I would think on an alloy bike wheel the alloy would be not as malleable as on a alloy car wheel..
Too getting it repaired,
If YOU hit it about what's too say in a few days or weeks the alloy disintegrated where you hit ,
due too an an unseen crack...or a weakness in the alloy...
A duff wheel could be dire for you and the other half...
 
Evidence of the offending hole is very important :oops:
The size and depth is also relative to the class of road, as is the frequency of checking required by the authority
There are national guidelines but each authority has their own set of rules both for sizing and how long they are obliged to remedy once reported
Deep delve into the local authority where the pothole was will usually show the criteria
Nearly all claims will initially be refused due to Section 58 of the Highways Act
It's a slog but was worth it in the end to me

They even have a progress map, maybe you can see if the hole has been reported? Much better for you if it has and it's not been done within their timeframe

Should you take this on and request DPA information, be very specific in what you ask. If you ask generally they will answer generally
You can ask lots of individual questions on on request

The repair logs I received 1st request looked OK, 3rd request gave much more details and showed a lax attitude by the operatives recording of road defects in question

As has been said, evidence, size matters

You will need to get 2 estimates for replacement or repair and the cost of repair will include transporting the item for repair, the whole lot. The big thing I learnt from my experience is claim so that you are not in a negative state at the conclusion, as opposed to making a few quid on the deal

My argument for a new alloy on the car, but it was only 2 months old
On my last bike I had a repair done on the front wheel as it was only on the outer lip, but the wheel needed re-spraying after and was out of action for a couple of weeks
It was my fault so couldn't claim for that one
 
My daughter hit a pothole which popped the tyre and damaged the rim. Photos were taken and the garage that replaced the wheel gave a report saying that in their view the damage was consistent with hitting a pothole. Claim was successful and fully paid - new wheel (not repaired) and tyre.
 
If everybody claims for every bit of damage, they’ll eventually learn that it’s cheaper to fix the roads than fight the claims

Might be a long slog though

As old croc states....have a look on Fixmystreet, Councils have previously got out of paying for damage if the pothole or cause of damage had been unknown to them.

This sort of thing...

A friend of mine had her wheel repaired at motoliner.com in Maidstone a couple of weeks ago, cost was £100 plus postage, her wheel was a lot worse than yours.
 
Had a claim in against local council on my Audi for a damaged wheel and tyre it was initially refused until I sent in photos with full measurements , also probably helped that the vehicle I used to protect the scene when doing photos and measurements had battenberg markings and blue flashing lights on the roof !!!!!!

Seriously though they let the pothole ( which was on the exit of a blind bend) get so bad over the following weeks that a number of vehicles were damaged and we had to threaten them with a road closure before they acted
 
Thanks for the replies - I’ve booked it in for Motoliners this Monday…they’ll change the back tyre (2mm) as well as the front while I’m there for a nominal extra cost. Really helpful on the phone.

Just got to work out how to strap on 2 tyres for the trip down from Worcestershire ! Any explorer types got any tips ?
