had my first motorcycle accident yesterday - what should I do

To all and sundry, i had my first motorcycle accident yesterday on the B709 just outside eskdalemuir, riding steady about 35-40 mph towards a left hand
bend, a black audi came round the bend on my side of the road leaving only a couple of feet of clear way,i tryed to swerve but hit the drivers door passenger door etc, next thing i am led under my bike with a painfull knee and foot, two motorcyclists stopped and picked my bike up and i managed to stand,
i rode home 140 miles because i would rather be home with bike rather than mile away, people in the audi were very good and attentive,
notified my my insurance today,
what should i do now, my yamaha t7 has limited damage, front crashbars tookmost impact, rear luggage rack the same, mirror loose and a couple of scratches,

Your insurance should take care of it all and they'll speak to the other drivers company. If he admitted liability and doesn't retract it then all well and good. If you had witnesses I hope you got their details, and while at the scene you got plenty of photo's of the accident including various wide angles of the location. It may take a day or two for the pain to kick in but if you rode your bike and the adrenalin has worn off, it sounds like you got away with it but still get checked out if you do have any prolonged pain. That's it, sounds like you got off lightly, so count your blessings and fingers crossed it will be many years until you have another close call. I'm sure that someone with more recent knowledge will add to this if I'm wrong.

Did you notify the police if not do. Have it logged on their system.
Was there any Witnesses if so and you have their numbers contact them ASAP and ask them to text you their account of
the accident so you have it in writing.

I hope I'm wrong but would put money on it Audi people will take stock of the shit their in and will come up with all sorts of BS to minimise their responsibility and put it back on you

Have you a dash cam on your bike 🤞

the young couple rang for an ambulance, but i refrained because i thought it was not an emergency,
dont have a dash cam and no witnesses, think you may be right, but am hoping they will accept responsibility,
am not trying to make a big deal ,my access is 500 quid, sure i can sort my bike for that money, as for jacket pants and helmet, wear and tear,
am lucky my employers will pay my wages for a time, thank you for your reply,
 
The trouble is, if they claim it was your fault, they will try and claim off your insurance and your future quotes will take this into account and will rise, that's the biggest problem. I once had a fella in his van take out the rear end of my car, he accepted responsibility at the scene, then denied it. Thankfully I had plenty of witnesses and photo's so it went well in the end. Fingers crossed they are honest people, we have to have faith that there are some still left in the world.

At the end of the day you got away lucky, so I'd be happy too. Having a car on your side of the road normally ends in a far worse outcome. Trust me I know. ;)

If, as you say, the third party (ie. the Audi driver) was to blame, then claim against them. When successful, the third party will:

A. Pay for all the damage to your vehicle.

B. Pay for your excess.

C. Pay for any injuries (bodily, loss of wages and the like) you have suffered.

D. Pay for any damaged clothing, helmet etc.

You should have gone down the ambulance route. If an ambulance is called, there is a better than average chance that the police will be called, too. If the police arrive, they’ll be able to pretty soon establish who was to blame. You might even see the third party, who arguably came close to killing you, prosecuted.

Or don’t bother with any of that and pay for the lot yourself. Your choice,

Bods love a picture.
I would imagine without any it will become difficult to prove unless the Audi couple confess all

Was it north or south of Eskdalemuir?

Although it’s a bendy road - the B709 usually has good visibility if you’re riding with decent positioning, as a motorcycle rider

Did you get a view of the Audi before entering the LH bend ?

Then stop trying to be nice!

Remember that the people deciding on who was responsible are in an office and are relying on whatever evidence is provided by you and the other party.

If there are no witnesses, no video, or no photos - the Audi could boldly claim that you were on their side of the road. And then it’s just your word against theirs and the office bods have to guess what the truth is.

(I had a car accident when exiting a roundabout where the other driver claimed I hit him and I claimed that he cut into my lane to make the exit which caused me to hit him - their insurance admitted full liability the moment they were shown the dashcam footage).
 
Similar sort of thing.

I was filtering past a line of stationary traffic and just as I was passing a car, it pulled out to see if it could do its own filtering to a set of lights 50 or so meters ahead. It caught my back wheel, punting me into a car coming in the opposite direction.

Her insurer denied liability (I even had a witness write a statement that I wasn't at fault) until the occupants of the car I was punted into, claimed whiplash injuries (FFS), pointing the finger at the driver that hit me. Only, then did they admit liability.
 
Photo photo photo. Saved my bacon when I had an accident 2018. Their insurance co were doing the usual. Minute they seen photos they immediately accepted liability. JJH

It also helps when the cops come that they charged her with dangerous driving and assault. After she knocked me off the bike she hit me with her clenched fist as I was wriggling from under the bike. Probley shouldn’t have called her a ****. JJH

In answer to all your replys, the man in the audi has admitted full liability, his insurance company (aviva) have rung me to take pictures of the damage to my bike and clothing, my knee is still swollen, only soft tissue damage, foot is getting better by the day, had another x ray this week and bloods , they showed up raised potassium levels, only 5.5, 3.0-5.0 is normal i believe, i did not have any photos or witnesses to the accident,it was just north of eskdalemuir a slight kink in the road about 5-600 metres before buddist temple,
thanks for all your input everybody, at the time i just was glad i could still feel my toes etc,nowt major, i managed to stand after 2 motorcyclists stopped and lifted my bike up, just wanted to ride home and chill out, i dont want to milk the accident just get back on my feet and back to work , i have contacted my insurance company, Hastings, they immediately reminded me of £700 excess, which did piss me off a little, does it matter if i deal with aviva directly, or let hastings deal with it,
 
Don’t worry about your excess. The third party has apparently admitted liability and will meet your legitimate claim, in full.
 
Plus one for get a camera on board. It can also have a sobering effect on the way that you ride.
