HELP - 3rd party hit me, insurance blustering

Remove the mention of the Colombres rally, and put planned and paid for vacation to Northern Spain.
Insurance company may classify the Colombres rally as competitive, which could invalidate insurance cover

He’s claiming off a third party. He could say he was planning to go to the Moon.

Can i ask why you never claimed though your own insurance and got them to fix your bike.
They would of then had to do the work to get the 3rd partys insurance to repay the costs.
Because on the Monday morning the trike insurance people phoned me with the claim number. To be fair the event stewards were brilliant, collated all the details from each bike hit, owner's name, registration, photographs of the pile up (of which there were dozens, of course), witnesses names, including the parking stewards who saw it all happen. I was put at ease that it was such a cut and dried case I dealt direct with them.

I must confess I wondered how the opening post of this thread, squared with this statement from November in the olther thread;

Anyway, I have got hold of the underwriters and they are appalled at the situation, immediately kicked the loss adjuster (or whatever they were) into touch and have taken over everything themselves - straight away approved Mikeyboy to do the repairs. Finally, some forward progress

Which suggested that the repairs to the bike (to be carried out by King Rat’s preferred repair maestro) were - at last - agreed and could proceed. But I decided not to delve too deeply into the murky pool.

I think you need to decide which of the two threads takes precedence.

This one, with its apparent zero progress but, with the added twist of compensation or the other one, where things seemed to have at last sorted themselves out.

This is a continuation of the other. That was as far as the first call to Markerstudy and speaking to 'Mark' on November 27th, after taking the new header pipes over to Mikeyboy and speaking to him. So maybe carry on with this one, as it seems to have the 'before' and up to date.

It now seems they haven't.... because the engineer hasn't signed them off. I think it is because it is a new handler every damn time.

In response to the above comments I have gone back over the emails on that day. I wasn't quite clear in what I wrote here - they have agreed that Mike can do the repairs, it is the estimate that he has provided that has yet to be agreed to and requires the engineer to sign that aspect off.

With regard to my claim for when your insured careered into the assembled, parked, show bikes at the Daventry Motorcycle Festival on 8th June, 2024 at approximately 09.36.

I wish to escalate this to a formal complaint.

I have been in touch with a specialist motorcycle crash solicitor and they have given me advice, which I am following.

Please find attached my formal letter of complaint outlining the timeline of events since I was contacted by VRG on the morning of 10th June, 2024.

On speaking with Mark in your office on 27th November, 2024 about this matter he spoke with underwriters whilst I was on the telephone to him and it was verbally agreed that Mike Overy at Overland & Classic was approved to do the necessary repairs and obtain the necessary spares, it now just falls on your engineer to approve the estimate for those repairs. Please note that I am also claiming for recompense for my time, trouble, stress and heartache together with loss of amenity due entirely to the obstructive tactics applied throughout this claim.

I think I’d be claiming off my insurance and leave it to them to sort out. You’ll have to declare it anyway and even when it’s not your fault the premiums still go up!

Email when I got home yesterday - engineers have agreed the repair estimate! :thumby:

Now to ask them if they want to negotiate my uninsured losses direct, or through a solicitor/lawyer, which will of course add costs.

Dear Markerstudy Claims Team,

Thank you for agreeing the estimate of repairs to my machine. The repair workshop can make a start in the New Year and will get the paintwork away to be done as the first job. He can then dismantle and replace the broken items while the paintwork is being done.

As per my previous communication, I do require compensation for the loss of amenity and the heartache, time and effort spent and constant worry that trying to get the claim to this stage created, due entirely to the delay and obfuscation by your claims management company. Will you negotiate direct with me, or shall I appoint my legal advisor to create that part of the claim? Of course, instructing a lawyer will increase the costs to yourselves. I have done my best to mitigate the cost of this claim, even to the point of not taking the hire bike offered by your appointed claims management company, who did you a great disservice by obstructing my claim and payout at every opportunity.

I await your reply and shall proceed accordingly.
