Having been a regular and on occaision , somewhat patient customer of Motorworks for two decades plus , it was with some sadness that I found myself coughing up the registration fee this afternoon for a hearing in the small claims court , citing Motorworks as the defendants .
When in the past Motorworks made a ricket they were apologetic and did their best to sort the matter out to the best of their ability . Even when they made the same mistake twice in succession , we arrived at an agreed solution to both the problem and my resultant angst .
Today however , we reached a parting of the ways and will next meet in the County Court in Leeds some time in the next three months .
The reason for this ? Not the Touratech ceramic clutch sold to me by them that proved not to fit (three mil. too thick - hence not able to engage clutch at all) . Not Nord , his usual courteous and helpful self . But Managing partner Chris who , having refunded my original £297.60p purchase price , felt unable to consider refunding any "consequential loss" incurred by myself as a result of their unfit for purpose retailed item .
I was not asking for any monetary recompense for the bike being off the road for a week , for my missing a track day , or for my spending half a day's leave going to see Motorworks about the matter . What I was wanting was the payment for my second amount of workshop time @ Allan Jefferies , necessitated by them having to dismantle and then rebuild the clutch twice - something directly caused by Motorworks "unfit for purpose" retailed item . Chris was of the opinion that he would only refund me such costs if he was successful in his quest to recover said costs from Touratech in Germany !
We now will both lose - me a half day in court , coupled with being unwilling ever to use Motorworks again and they are near enough to get to in an emergency , and they a customer , half a day in Court , any award made by the Court , bad publicity and any fees they might incurr should they chose to instruct a solicitor
A sad day for one and all !
Still Motorwork's loss will no doubt be Motobin's gain .
