Having been a regular and on occaision , somewhat patient customer of Motorworks for two decades plus , it was with some sadness that I found myself coughing up the registration fee this afternoon for a hearing in the small claims court , citing Motorworks as the defendants .

When in the past Motorworks made a ricket they were apologetic and did their best to sort the matter out to the best of their ability . Even when they made the same mistake twice in succession , we arrived at an agreed solution to both the problem and my resultant angst .

Today however , we reached a parting of the ways and will next meet in the County Court in Leeds some time in the next three months .

The reason for this ? Not the Touratech ceramic clutch sold to me by them that proved not to fit (three mil. too thick - hence not able to engage clutch at all) . Not Nord , his usual courteous and helpful self . But Managing partner Chris who , having refunded my original £297.60p purchase price , felt unable to consider refunding any "consequential loss" incurred by myself as a result of their unfit for purpose retailed item .
I was not asking for any monetary recompense for the bike being off the road for a week , for my missing a track day , or for my spending half a day's leave going to see Motorworks about the matter . What I was wanting was the payment for my second amount of workshop time @ Allan Jefferies , necessitated by them having to dismantle and then rebuild the clutch twice - something directly caused by Motorworks "unfit for purpose" retailed item . Chris was of the opinion that he would only refund me such costs if he was successful in his quest to recover said costs from Touratech in Germany !
We now will both lose - me a half day in court , coupled with being unwilling ever to use Motorworks again and they are near enough to get to in an emergency , and they a customer , half a day in Court , any award made by the Court , bad publicity and any fees they might incurr should they chose to instruct a solicitor
A sad day for one and all !
Still Motorwork's loss will no doubt be Motobin's gain .

Interesting.......sorry you've got a bad deal from them....gotta say that your grievance seems most reasonable .

Just FYI, I've had a problem with a WUDO 'zorst lowering kit from Motorworks......there were some time issues so as I had the ADV in for a service the day after the kit arrived, I took it along to Prestige with the bike and asked them to fit it......

That night, Prestige told me they hadn't been able to because the parts wouldn't fit ...ultimately this has proved to be wrong but that's irrelevent here......they 't actually charge me for the labour they'd apparently used attempting the fit however the point was clearly made that they'd spent time on it.

When I subsequently spoke to Bob at Motorworks, (and this is the bit relevant to your post) he was very apologetic and helpful, and asked if I'd been charged for the labour.....the insinuation from the way he asked was that they'd pay up for it, though this wasn't expressly said......and he did say to me thismorning when I spoke to him again that they'd pay for the postage of what at that time appeared to be faulty goods back to them......so they're not averse to taking responsibility in all cases.

Don't know if that helps you at all James but good luck with your case.

Sorry to hear of your recent experiences with Motorworks. It really does sound as though one person's attitude has ruined it for all concerned. Having only used them on a couple of occasions I am surprised to read your comments but will now be a little more circumspect before using them for anything substantial such as a clutch.

I hope that the court hearing goes as well as can be expected.
 
James, maybe something you already know, but there are spacers you fit when installing a ceramic clutch, to allow for the extra thickness, which are removed around the 45-50k mark after installing when its bed down to normal.

just thought i'd pass it on .

Got to agree - i've used motoworks twice now , both times had an issue with them.

Switched to Sherlocks now.

i know, but he would know what he received from Motoworks, if the spacers weren't included in the kit he's onto a winner, if they were included, did the dealer fit them ?

Spacers , what spacers ?

Not just me but Chris @ Motorworks was asking if the ceramic plate required additional bits to make it work and checked his own company's catalogue to see if it stated that anything was needed to effect the change .

The catalogue said nothing and Chris's comment was , " Well if anything was required it would say so here !" .

Seems as if the blind are leading the blind - Oh for a one eyed man ! - Step up Steptoe and take a bow - please educate this B.O.F. as to the arcane subject of spacers et al , so that ; even in 55,000 - 60,000 miles from now I can have a ceramic clutch plate as originally hoped for .

Hmm, I'm in retail too, although not bikes, and have used Motorworks many times and found them to be helpful and oblidging, always.
In the nicest possible way, did you rant a bit and p*ss them off? told them how to do their job properly? nobody likes nor deserves this, they're trying to do a good job too.
If customers 'act the biggun' it REALLY upsets us as we try very hard, without the customer we have no business, an' all that...
I'd be very interested to see what happens, my guess though is that MW will settle just to get rid of you.

Eyeguy -- As we have not met and if we do we are unlikely to be occupying the same situation as Motorworks and I were last week - I'll have to ask you to take it on trust that ranting and raving are not my usual modus operandi .
On the contrary , when peeved I tend to become even more horizontal than my normal laid back approach - in short the more wound up I get the quieter I appear .

Some eighteen months ago I experienced a litany of poor service from Motorworks ( they twice sent me BB power chips for a R1150GS , as opposed to that for a R1100GS) . this caused me to have to cancel a pre-booked session @ Hobb sport and have the bike off the road for ten days .
Following my complaint , Motorworks apologised and wrote to me stating that they were remiss and offerring trade terms for my next order , this as I had been a , " loyal and regular customer of theirs for many years" . Hence not someone given to a bit of a rant .

In this current instance and now claim , I will be presenting that letter to the Court to support my assertion that I am far from being a , "vexatious litigant" .

In short , I am significantly annoyed with Motorworks' managing partner Chris' attitude , who seems to be attempting to pass off his legal responsibilities to Touratech in Germany , where in fact my contract was with him , not Touratech .

It is perhaps Chris's misfortune in this instance to have annoyed someone employed as an officer of the Court and used to working therein - but he may in future consider his approach to customers whatever their profession / calling .

Having read the above , I think it only fair to add that I do become vocal , aggressive , even obnoxious , whenever Wales are losing to England at Rugby - having grown up in the era when we went twenty nine years without defeat at home to the old enemy - my excuse for such behaviour is that I was not raised to lose to the English !

Bloody hell James, you must have been apopleptic a lot over the last few years then ;) ;) :D
