where the wind doesnt blow

an email fromworld of camping , from Coleman..

Hello Paul

Thank you for sending those photos in. I have discussed this matter with Coleman and unfortunately they do not agree that it is a manufacturing fault.

For this damage to have happened, it must not have been erected correctly or pegged down sufficiently and must have been up in strong winds.

They have said that event shelter is a fair weather shelter and not a storm shelter. It wont withstand very strong winds and should be taken down if such weather occurs.
However they have had one up for 2 and a half months at Coleman base camp and this is absolutely fine.

They have said that they are not willing to take it back for refund or replacement, so unfortunately we are unable to do anything for you in this matter.

I can however give you details of somewhere who may be able to fix the fabric for you, but you would need to replace the poles yourself.

I am sorry I could not be of more help.
Regards,
Lyssa

And a reply from me....

HI Lyssa,
thanks for the prompt reply, however i dont agree with Mssrs Coleman on this occasion.
The shelter belongs to a BMW motorcycle club based on the internet, and if you would kindly inform Mssrs Coleman, that i will be posting their reply on the forum, to warn any prospective purchasers of this product ,and its inherent design flaw, and poor customer service.
No doubt one of our members will be in the law fraternity, and we will be seeking their advice on the sale of goods act 1984 and the goods being fit for purpose.
I also will contact my credit card company also and see what they recommend on this finding.
You also state that Mssrs Coleman has had one erected for two and half months with no problems, so where they are in the world, where the wind doesnt blow?, is this correct, is it a wind free zone?., do tell.
many thanks Paul Smith .

What does it say in the instructions/booklet/box that came with it - does it mention fair weather use only?

It does not state this on the Coleman's website http://www.coleman.eu/IT/p-23473-event-shelter.aspx

Overview
With its wide dimension, the Coleman® Event Shelter is ideal for any outdoor event or activity. Features UV Guard™ protection that will protect you from the UV rays.

Their gazibo is probably in the factory showroom, and any way it wasent storm conditions was it? a normal english day well done for chasing it and good polite letter to them so lets hope something good comes out of it,
Sale of goods act sounds a good start how about trading stds? all councils have one.
Good luck with the case,
Dave GS

Well done Paul, succinct and to the point - it's worth a try nonetheless, and I especially like the piece about the BMW club reference & posting their reply on the website :thumb2
