Last Saturday with only 20 miles showing on the fuel range I part filled a can with unleaded and went out for a ride just to find out how accurate the fuel range counter on my new GSA is. When it got down to the four dashes i.e. 'empty' I set the trip then did a further 9.8 miles before my bottle went and I decided to fill her up :clap

Sat in the fuel station on the centre stand I brimmed the tank and according to the fuel pump readout it took 35.8 litres

Not too bad for a 33 litre tank

My question is this:

Is it possible that the 1200 GSA has a fuel capacity larger than that stated or should I be contacting Trading Standards/Weights & Measuress and getting them to check the buggers pumps ??? :spitfire

I frequently get over 22ltrs in my standard 1200GS's tank...bizzare isn't it.

you might be overfilling it, or their pumps may be dodgy. Balance of probability says both are correct to some degree. Full to the designer allows for expansion room and some slop in the top of the tank. If you brim it, you'll probably get more in than the spec states. BMW also tend to be far more conservative in their weights and measures than many other bike manufacturers.
