Bike got squashed while parked up... likely damage?

@Guigsy insurance will delete his no claims until they have sorted things out with the other insurance company. However, they may will have it as a job done and closed so keep chasing to make sure it is eventually sorted out. Hopefully there is legal protection insurance in place to help with recovering those losses.
 
There would appear to be a bit of confusion over the role of insurance here. Insurance and liability are completly seperate issues. If someone is liable for their actions then they are liable. End of. If they have insurance then that insurance will indemnify them for their liability to you. It does not indemnify you. The talk of the accident occuring on private land etc in no way lessens the drivers liability to you . Whether he can get HIS insurer to reimburse HIM for HIS liability is HIS problem. If the police can identify the owner of the vehicle then you can take a civil action to recover every last penny of your inconvenience including taxis, buses, etc. You do not need to involve your insurers at all.

The OP will probably win but the one snag is actually getting paid. Technically non payment of costs & damages is contempt of court but courts very rarely go to those lengths.

personally I would go down the insurance claim as if new parts needed this could be expensive and insurance co may write off as cat D depending on how old your bike is . My 06 was written off last year with a lot of scuffs and scrapes , they even quoted for a ding on the exhaust to be replaced by new can . Bought the old girl off them for £2100 and kept the ret £3800 to do the old girl up bit and pay off the overdraft , she is nearly back on the road albeit with a few scrapes still showing and now owes me nothing except some good times again , insurance company reinsured her for Third party only but that's now my risk
