Lost all faith

Didn't they offer you a new bike early on but as you didn't want to pay for the re-coding of locks and first service etc you turned down?

BTW, when they fitted a new engine in my bike they stamped the original engine number on it as the old one was being scrapped - no need to notify DVLA.
 
I have to say.....The issues I had with my bike from new, were sorted by the dealer in a most pleasant way.
The BMW aspect (recovery that never took place) was absolute shite, the amount of aftermarket shite from BMW was horrendous, they eventually sent me my cards and all that old shite, but it is all wrong.
Of all manufacturers I have dealt with in 30 year of buying vehicles, BMW are without doubt the worst and I will never again buy anything new from them.
I have two letters of apology here from BMW, but only because they sent the same letter to me twice! If an organisation cannot manage it`s administration, what else can it not manage? You really do have to ask that question.

Well it seems that Richard Heith @BMW Motorad UK has taken back the offer of a replacement bike for my broken 2017 GSA TE and won't let me have another

AFTER talking to him twice on the phone and him telling me that he doesn't think I'm worthy of BMW Motorad UK and to even own one i am lost as to what to do and for words

Unfortunately there are people out there reading this who can't wait to go and speak to Marshall BMW Grimsby and tell them what i have wrote as it seems

Well all i can say is it has been a total waste of my time and effort to support them as they just basically told them they don't want me to own a BMW and that they can pick and choose who they deal with

Is this a 2017 bike as bought in 2017 or a 2017 model bike.

If you have bought it in 2017 then you have consumer rights which include giving the dealer one chance of fixing the bike or you can get a refund.

If you bought a 2017 MY in say September 2016 then offering you a refund with a deduction for wear and tear is fair enough.

How many miles on the bike?

2017 bike bought 8 weeks ago and told them about the problems from just over 100 mls on the clock and a few days old
Got told it was me and it's got running in oil in it and to wait till it's been serviced
Did everything they asked for and it was proven to be faulty by Steve Bell from BMW Motorad UK who also came to ride another bike with gearbox problems and his also had issues

a) Lock recoding
b) 1st Service
c) Cost to changeover your insurance

MCIA will agree a repair or refund is perfectly acceptable

They don't have to offer a new bike

A new bike is a gesture of goodwill, not a definite

In law they only have to repair or refund

You have shot yourself in the foot by shooting your mouth off on here, at every end and turn about it

BMW have read it and retracted their goodwill

In business I would do the same

Customers like you aren't worth it

I would refund you in full and complete my statutory duty

Matt - I genuinely feel for you and Johnny is correct legally regarding that they have the right under law to attempt to correct it first before offering a replacement or refund. Seems you won't be offered either of them in the long term. You can't turn the clock back and get them to change their mind.

Personally, I wouldn't be that worried about changing the engine etc. There are so many out there that have had it done.

Please don't take this the wrong way but you've got to stop thinking about what the episode will do to the resale of the bike at some stage in the future and concentrate on getting it fixed and enjoying it NOW. Swallow your anger and pride, take it back and get the engine replaced. Don't worry about what they will 'think.' It's not helpful to adopt a win or lose mentality but I understand that it's very natural to do so and have done so many times myself. You may well keep it years and by then this episode will have no effect on it's resale value whatsoever.

This episode is only eating away at one of the participants and it's not BMW.

Or explore the legal remedy that someone has helpfully posted. It's got to be worth a phone call and a few quid? unfortunately, IMHO they will point out the sale of goods act to you.

I am not a die hard BMW fan who can see no fault with them. They've got plenty but so have all manufacturers/bikes.

Someone work for BMW by any chance ?
It's ok there are other things going on behind the scenes to which BMW should take note on but that's for another time and they got a shit load more to come which i have not said on here or anywhere else
BMW have made me more to be against them than for them and thats there own doing by retracting there original offer

Well said. When my bike was replaced by BMW, I didn't say a word until afterwards. Even then, I didn't go into that much detail, nor would I now, nearly 4 years later. The OP has shot himself in the foot by airing his laundry in public. The only thing he can do now is take the refund, close the thread, and move on.

I couldn't give a fuck if BMW got there butts hurt over this and it's about time more people fucking stood up and was counted with there rusting bikes issues and everything else that goes on with them and i am well within my rights to complain about a product that i have spent £17000+ on the same as everyone else has and will carry on doing on this and other forums etc
If BMW don't like it then i suggest that BMW stopped making them like they do and step up there game to which is supposed to be a top brand name
This and all the other stuff that people complain about is just wrong
