Accident

Guards said that even though them parking in the middle of the road caused the accident I should have been able to stop. I didn't hit their car I went straight into an oncoming car as the bike skidded out of control.
 
Didn't like to say, but you should be able to stop within the distance you can see.

Just because there shouldn't be anything there doesn't mean there won't be... child, tractor, sheep, nuns.....

In that case on a blind bend you should not drive faster than 20 MPH or less. Even better have a man with a Red flag in front of you. Can't argue with however.
 
Im glad you survived that and I wish you a speedy recovery, if your with Carole Nash, I would advise you get your own insurance assessor, I had some shit with them a few years ago, depending what your mechanic says if the bike has to be written off having your own assessor to fight your case will be better for you.

Sorry to hear about your misfortune, but glad you are reasonably ok.

As for the bike, it is just a "thing", and can be repaired or replaced.

Worried about loosing my no claims with CN. Do they have a no claims protection policy as standard. ? I won't be home to review my policy documents until tomorrow.
 
Jaysus, that's a nasty one. As others have said it could've been even worse, glad to hear you're relatively ok.
+1 for Banzai's comments re proper doctor attention, especially when insurance claims are involved.

That's what I was afraid of.
That's the theory but, as you correctly say, not always realistic.
Would it be worth pushing the guards to charge them with dangerous driving (well, parking), thereby strenghtening your case. Given they're tourists, probably a waste of time.

If you drive into a parked car (or swerve to avoid it and hit something else), they are merely contributing to the problem of you not looking where you are going.
 
Poor observation, you can have all the bike electronics in the world and it will not change your ability to look where you are going or to drive within the speed that you can safely stop. ABS simply masks the problem of poor riding. Just saying like....

however, I am pleased your relatively Ok aside from a few battle scars!

What speed do you ride around blind corners at?
 
Checked the photos. There was a continuous Yellow line where they were parked.

I was thinking about this last night and it was the thing that kept coming into my head - road markings. They knowingly stopped on a bend with solid lines. Idiots.

Other than some major emergency they had no cause to stop there. What if you had been replaced with a coach or a truck, the outcome would be much much worse ( thankfully you're ok ). Im sure the cops would be pointing the finger at the tourists who are complete t!ts if they had of caused a huge accident with a coach full of ppl or a truck. the fact you're a bike ppl automatically think you were speeding. Dont be judged by one or two comments here either, ignore them.

As also said, ( which I didnt want to say yesterday ), ABS is not a get out of jail card, if anything when you need full anchors in the dry, you can outbrake ABS and stop quicker.

Do not let this go, i think you should definitely pursue it. Draw a diagram and go through it step by step.

it didn't come into his path. it was parked FFS! i have no idea if he was legally speeding, but he was categorically going too fast for the road, or he would have been able to stop :blast

rule number one - don't ride into somewhere you can't see far enough to stop in. i know we all do it, but there's really no defence when it all goes wrong.
