right first off I don't know any of the partys involved in this but the way I see it is this

Thunder and Civil did a deal for a set of panniers that Civil would hopefully lead to more sales, not an unreasonable deal in my view, but the caveat being if less than 3 sets of panniers where sold then Thunder owed monies to Civil. this situation has no bearing on the situation between Civil and AndyT and is upto Thunder and Civil to sort out

Thunder then sold bike to AndyT including the panniers, which then developed a fault in the powder coating, so is the expectation of AndyT unrealistic in expecting a warrenty on these 2nd hand products, I have to say yes, he maybe disappointed with the product but to expect Civil to repair the fault under some implied warrenty is a little unfair. However I also think Civil has been a wee bit short sighted in this misadventure and seems to have made his deal with Thunder cause some clouding around the issue with AndyT.

Also the original selling thread was hijacked big time for some apparent reason :nenau

Regading the MOD's situation in all this is quite simple as soon as he became aware of it he closed the thread, MOD's are human after all and have a life out with this site, so fault on the MOD's as far as I'm concerned

Having said all the above, I had a look at the Caja Sahel website and if I was in the market for some panniers I think I could buy with confidence based upon the site which has a very professional feel to it.

just my 2p worth, I also feel ironically that this thread should be closed to stop any more Civil bashing

I agree..............

although I'm sure you ment to say..... so no fault on the Mods....

Bubbled paint big deal

Get a life

Very true Bakes:clap

We have a forum member lying in a hospital in Malaga after suffering a very serious and life changing accident and another forum member whose wife is undergoing chemo for leukemia in a Brussels hospital

Paint coming off panniers is hardly anything to worry about and the former paragarph is where life really matters

As for the whingers/naysayers on the sidelines.....................get a fcuking life:rolleyes:

Yep definitely more important things in life than paint bubbling up...

Only when 'underinsurance' comes into play (ask Wapping)

If you say it's £5000 and you really need £6000 to replace like for like (or more from a dealers) then they'll play the underinsurance card and you'll probably get £5000 tops

:augie

I think you will find the chap Thunder sold the bike to is called Alex:blast

quick Edit needed before anymore shenanigans ensue:augie

Feck'n Doh! :blast you are quite correct my apologies to AndyT I should have wrote AlexT

I agree..............

Double Feck'n Doh! :blast:blast again you are correct it should have read "So no fault on the MOD's"

Well, as regards the original post, I'm afraid that I cannot 'hold my head in shame' as a moderator because I have absolutely no powers in that section.

No mod is shamed, they have done nothing wrong.

Now to the crux of the matter;

After 69 posts, the correct question has yet to be put to the correct person.

The question is 'Did you trade these goods as a private individual or as a trader?'

The question needs to be answered by Thunder IMHO - Not Civil.

If Thunder bought and then resold the goods as a private individual, then AlexT bought second hand goods in a private sale with no entitlement to warranty unless stated in writing - end of.

If however Thunder bought the goods at some sort of 'trade discount' with the intention of further sales leads (as Civil states) - then, even if further sales did not actually ensue, Thunder was acting in a trade role making (or hoping to make) profit by purchasing at a (trade) rather than a retail price.

If the latter is indeed the case (and I really don't have a clue - only Civil and Thunder can answer that one) then any liability towards AlexT rests legally with Thunder (as the retailer) not Civil as (in effect) the wholesaler.

Perhaps Civil might like to ask Thunder to confirm or deny whether a 'trade' price was sought and/or recieved :nenau

A storm in a teacup indeed - but business reputations are hard to achieve and easy to lose, and if matters are as Civil has stated, he is being threatened with damage to business reputation unfairly.

All IMHO.

"pikey" ???? NOT what I expected on a site like this. Bloody offensive. Uncalled for. I am questioning why this has gone unaddressed.

I do not often get mad (maybe its because I am still waiting for the GS to be delivered) but that word i find so very offensive. I am calming down now I am looking at GSA piccys..... I will let you know if I start to raise again

Aidan sorry to hear about your father.

The orginal thread was out of order a
blind man on a gallopping horse could see
that it was nothing to do selling...
and I believe something should have been
done early to put an end to it...
As I said before I think the whole sad sorry
tale has been handled very poorly...

I will now close this thread...
