New gearbox needed

I posted here recently 'clicking noise from drivetrain' Just to update you I took my GS to the dealer today and the technician took it out and came back 2 minutes later. Looked at the service advisor and said "can you order a new gearbox for it please". I purchased this bike just over a week ago, it is immaculate with only 6000mls.To be honest all the staff looked embarrased.They gave me a loan bike there and then and promised to call later to update me as to what they are doing, which they did. Anyway thought I was going mad but at least I spotted something was wrong and have a BMW warranty.

Welcome to the wonderful world of BMW reliability.............we forgot to mention it when recommending the GS to you, initially.

Two options.

1) Refuse the repair. Reject it under the terms of the Sale of Goods Act and get your money back. Goods unfit for the purpose etc etc.

2) Keep the newly repaired bike safe in the knowledge that the bike you bought just the other week is now even better because it has a brand new gearbox. Or does it? Maybe the "new" gearbox that goes in will be reconditioned after doing 60K miles on somebody elses bike. Maybe you now have the worry of what else will go wrong with the bike which may well be a lemon. Do you know why the previous owner sold it. Do you have the warranty history for the bike.

I think I will hesitantly go with option 2, but am I naive enough to think that they wouldnt fit a brand new box. What about the clutch is there likely to be any contamination ?
The bike really is in mint condition with good service history and well known to the dealership. I dont have any warranty history though.Can you obtain this ?

I have been looking at the history of the bike and their are some bills for the fitting and removal of an Eprom chip and Remus exhaust by BMW. I know this is a mod a lot of enthusiastic owners have done but now im having thoughts of previous owner thrashing the nuts of it around the country.

If it were me - I'd possibly actually prefer a recon gearbox - at least you'll know it's been done by hand rather than on a production line. And as you say, the rest of the bike is immaculate and you've probably started 'bonding' with it now... As for your bike being a lemon - it could be, but I'm not sure such a thing exists - the sequence of coincidences that would have to take place in order that one specific bike from an entire production line gets all the f*cked parts is too high and makes the idea of a bone fide 'lemon' a myth in my book - unless you are extremely unlucky Having said that I'm sure a bunch of bods more knowledgeable than me will be along in a minute to debunk my theory!

Quite right Cookie, my engineering experience suggested that reconditioned units tend to be built by experts, whereas new units are assembled by semi-skilled workers.
Take the recon and tell yourself you have a better gearbox now.

i reckon 99.9% of riders are incapable of thrashing a decent bike.

i have all that on mine & i don't thrash it. a mechanically unsympathetic clod could damage a standard bike anyway.

Just spoke to the dealer who is certain it will be a new gearbox because this is what he has ordered.Having said that, he advised that BMW recon boxes only use the outer casing everything else is replaced. Im not that worried,pretty confident it will be done properly.Would like to be a fly on the wall when they inspect my faulty gearbox though.

Its always good to have another point of view and it prompted me to check with them.Im obviously not happy that this has happened but the dealer appears to be doing all they can, BMW are going to cough up for a courtesy vehicle and deliver it to my office. As I said I think they are feeling a little red faced about this and want to do the right and professional thing.
