Dunno about abroad (although I understand in California you can get fined for standing up !) but in the UK it would be difficult to prove. Whist I appreciate that as in a car, you would have to move your foot to brake. In this case you would have to do the same, only to a greater degree. This where it becomes subjective.

When the subjective element is introduced in court it becomes difficult to prove beyond a reasonable doubt that you could or could not brake effectively.

The CPS would need to be safisfieid of a reasonable prospect of a conviction to run with it (because they have "targets" too) so I would say it would be unlikely to go to court.

Having said that, I would take the bollocking and not leave it to chance. When I was a kid I learned early that it was better to eat humble pie and think scumbag rather than say it.

Not that all cops are scumbags - I think I am quite nice :thumb:D:D

Comparison between moving hand in car for gear control certainly adds a dimension to the discussion.

You could also add in a rider who has a right leg disability can still be allowed to ride with replicated controls - but as the GS brakes are dual linked you kind of already have replicated controls - just another element.

However again it might be easier to accept whatever you get at the roadside - as the end result otherwise could be very unpredictable and time consuming

They rely on their bark being a bit "unpredictable and time consuming". The bite will be somewhat toothless but none the less unpleasant.

By "They", I take it you mean all 125,000 of them. I personally would prefer to give a bollocking than a ticket/court appearance if I thought it would do any good. I would however try not to be condesending. Aside form anything else its more bloody paperwork.

BTW I said "I" would prefer a bollocking, this also applies if he/she is a lying sh1t and having not allways being plod, I have met a few. If you would prefer otherwise then hey, thats the choise you can make. It was not that long ago that I copped a £550 fine and 5 points for speeding. I would have prayed on all fours for a lying sh1t condecending bollocking instead.

Oddly enough, I have also met a lot of lying sh1t civillians. I suppose I could lump all civillians together and call them "they" but I don't think that is a good idea do you ?

I suppose its a bit like somone saying "I hate coppers" and me replying, "Wow, thats a coincidence, I hate civilians".

Of couse all of the above is bollox because police are actually civilians, but it was fun writing it !......195 days to retirement.....

Yes well fair enough. I just wish you would all remember that when you wear the uniform, the public do tend to regard you all as the same.

I would tell the officer that I disagree and that he should report me for the offence if he wants to take it further.

I fully appreciate what you say - and I agree with you. The point I was trying to make is that I would rather take a bollocking and walk away swearing under my breath and laugh about it the next day rather than worry about a court appearance for 6 months. I lost my licence for 6 months many years ago (before plod) and it was very painful so if I can help avoid it happening again by keeping my mouth shut (which was half the problem anyway) then I will. On the other hand If I am in the right I will fight tooth and nail. Just like I did when I collected the £550 fine for speeding, despite the fact that the limit signs were completely obscured by trees on one side and a hoarding on the other. Even my photographs did not match up to the lies of the scamera operator - should have pleaded and got a smaller fine - doh!
 
Bear in mind that you can actually get done for 'failure to control' if you are caught with your feet away from the gear and brake controls.

As I was reliably informed by the nice chap in the white and chequerboard graphic Range Rover with blue flashing lights when I was seen resting my feet on the crashbars of my R80g/s while riding it some years ago.

Yep..it does mean that being found using custom bike 'highway pegs' is an offence for the same reason.
Forward mounted controls are okay,but not plain footrests.

Don't see how having you foot off the gear select is being out of control of the vehicle. Would they expect you to take your hands off the wheel to bring a car to a halt in an emergency ? -no !

As for the foot brake - not needed with distributed braking.
Plod might report you for not being in control but it would never stand up in court. If he threatened you with a ticket - refuse it and say you want to be reported instead. The threat of all that paperwork for little result would soon make the whole thing 'go way'.

"Having control" does not just refer to the means of applying the brake(s). Try batting along at 70ish, nice and relaxed with your feet up on the pots.... and then jam the (front) brake on hard as you can. I suspect you may discover a new meaning to complete bollocks:D

(B.T.W. cruise control is only illegal when used with feet in an elevated position)
