Dunno about abroad (although I understand in California you can get fined for standing up !) but in the UK it would be difficult to prove. Whist I appreciate that as in a car, you would have to move your foot to brake. In this case you would have to do the same, only to a greater degree. This where it becomes subjective.
When the subjective element is introduced in court it becomes difficult to prove beyond a reasonable doubt that you could or could not brake effectively.
The CPS would need to be safisfieid of a reasonable prospect of a conviction to run with it (because they have "targets" too) so I would say it would be unlikely to go to court.
Having said that, I would take the bollocking and not leave it to chance. When I was a kid I learned early that it was better to eat humble pie and think scumbag rather than say it.

Comparison between moving hand in car for gear control certainly adds a dimension to the discussion.
You could also add in a rider who has a right leg disability can still be allowed to ride with replicated controls - but as the GS brakes are dual linked you kind of already have replicated controls - just another element.
However again it might be easier to accept whatever you get at the roadside - as the end result otherwise could be very unpredictable and time consuming
