Rear end collision - Help needed

Folks.

Was rear end shunted on M1 Jn 10 on Thursday night. Happened in nearside lane at about 40mph.

Driver charged with Carless Driving. I got a fracutred disc in middle of back and dislocated shoulder.

More importantly, panniers busted and back end of bike damaged. Bike towed and stored so apolgies no pics. Dealer reckon they can repair. Few questions
1 Accept repair? Both my other accidents were not my fault and bike write offs.
2. If they repair, what parts of the back of the bike are vuneralble and I need to check they have checked?
3. Is this a record- New Bike mid- Oct and crashed mid Dec?

I would be more concerned about a fractured disc in my back and a dislocated shoulder. The bike is just a lump of metal and plastic which will either repair or be written off. Hope you heal soon and stop worrying about the feckin bike.

you got to prioritise here, hope you make a speedy and full recovery.

If the bike has gone to a Motorrad dealer, I would not worry as they will fix everything.

Hope you and the bike are fixed very soon and the car driver up before the beak with a suitable punishment.
 
Sorry to read that Mike. I assume you were travelling at about 40mph and a vehicle travelling somewhat quicker ran into you. I'm guessing the speed differential was substantial given your injuries.

I would be very concerned about the following:-

Rear wheel, if it's alloy it should be scrapped.
Final drive, it isn't designed to absorb that kind of impact, BMW units are fragile enough as it is. The impact would then be transmitted through the swing arm and paralever.
Transmission, there could be a very sudden and severe change of rotational speed at the time of impact which may easily exceed the design parameters.
Frame, built cheaply in China the early ones weren't straight in the beginning, I'd want a full alignment and geometry check.

I'd actually not want the bike repaired, modern bikes are highly developed, comparatively light machines. An impact like that could result in all manner of subsequent unforeseen failures. If the insurers insist on repair I'd sell the bike immediately. Then feel guilty that some other poor sap might pay the price.
 
Serious injuries. So sorry to hear of the crash.
As for the bike ...I think you paid for a new one - so would expect it to be replaced not repaired.
Get a decent legal team involved ( Andrew Dalton featured on these pages a few times) and "stand your ground"
 
2 months old, write it off and get a new one from your insurers..............most offer 'new for old', within either 6 or 12 months of first registration

Thanks for the kind words and advice.
Quick phone call to Andrew Dalton, Insurance (Ageas) and got excellent advice on what to do. Daltons and my local BMW are on the case. Devitt's had passed it on to an 4th D accident management company. Soon put a stop to that as warrenity out the window.

Own injuries mean no riding till spring and cancelled my charity ride in Feb. Good problems to have could have been worse.

If it is a 2 month old bike tell your insurer to fuck right off and you want it repaired by a BMW dealer , mate had shit loads of bother with 4th Dimension a couple of years ago and they have an absolutely shite reputaion within the trade , a bunch of fucking absolutely useless shysters and inveterate liars to boot !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
 
Sorry to hear about your accident hope you heal OK .I had the same accident in June rear end shunt Devits and 4th dimension were great bike got written off and got paid out in full even all the accessories and clothing .If you want any more info send me a pm .

Again thanks for the kind words and advice.

The Folk on the forum were right, the issues with Accident Management Companies are huge. Read reports of one guy had bike taken and they had started work without his knowledge. Absolute bandits some of them.

My insurer Ageas have been very good. Confirmed won't impact any claims and have waived my excess and all in writing. Documents received within 24hrs. Local BMW dealer is an approved repairer.

Big thanks to SWB Mottorad (Lind) at Welwyn. They have picked the bike up for free today. 30 miles away. One lesson learnt is checking what you are covered for when it comes to recovery. The insurance company only covered one recovery/ movement of the bike ie off the motorway and no storage. It would have meant not getting things moving this side of Xmas plus storage bill. I would have to pay and claim back just after Xmas. The BMW rescue only covers you for the resuce off the motorway. Make sure BMW or your provider recover the bike at the accident. In my case I was out cold so couldn't

BMW pointed out it has ACF 50, Cymarc, Wunderlich and Nippy Normans protection all over the bike apart from the back. Nippy Norman or Mark you are missing a trick.

Just awaiting the damage report.

Got a hire car today with a view to claiming back via insurance. I am investigating the following. Local Enterprise Car Hire runs an accident hire car replacement. You give them the details of the claim they provide small hire car and sort payment from insurance companies regardless of fault. Sounds too good to be true so checking it out.

Sorry to hear of your pain, for my two pennies worth:

I previously managed the claim myself for this sort of thing. Depends on OP's insurance company and their attitude, Norwich Union suck, but I also dealt with Zurich and they were superb. Both were rear end shunts on two different bikes. upwards
The only problem with having your bike fixed is that it will get registered as a Cat insurance claim dependant on severity, this will devalue it by anything from 30% upwards making it very hard to sell on.

You should approach his insurance with a view to them replacing your mode of transport and being invoiced directly for this. I know you are injured however, twice when hit by a.n other at fault, I hired a bike with the invoice direct to the other person's company. The reason for the bike being it is expensive for them so tends to focus their minds on dealing with the claim promptly.

If you need physio or any specialist treatment they should pay for this directly also.
I know its a dirty word but there is also compensation at stake, there is an agreed amount for each type of injury so it wont be a fortune, however if you have lost earnings this should be covered in full.
Be careful on any settlement as the injuries you have sustained may not be the end of your problems, you may have issues further down the road.

I don't believe in ambulance chasers however you should not suffer for other peoples mistake.
