I'm still baffled about what the OP is after.
From what i can see he's bought a SH bike,
Now either he's
A) Fallen out of love with it
B) Decided it's not what he wants
C) Seen its had warranty work
Upshot is he wants his money back, or a wodge of compo, holiday in the sun etc
From a peace and love man, pespective.
Sure here's all your money back, have some compo, free holiday for life, and we'll close the
dealership in question out of principle .
From a Legal perspective
Your over 18, you read the documentation, bill of sale / finance agreement / service book, checked the V5 MOT cert, test rode and satisfied yourself the bike was as described and what you wanted. And duscussed in depth with the dealer. You signed the legaly binding contracts, bill of sale etc, and paid the money / finance & removed the bike from the dealers premises.
After the cooling off period, you have finally gone through the documentation, and found the dealer has replaced the engine under warranty, and now you have taken umbrage, convinced yourdelf the bike is a lemon / missold and want your money back
From a real world view
Caveat Emptor
In a nutshell if there is no warranty supplied or guarantee of satisfaction, then the ancient rule applies - Buyer Beware.
Even if you were to take it back to the dealer under consumer law, and make a successful claim, the first option is for the dealer to repair or replace.
Only if they fail to repair would you get a refund..
So at best your going to get another engine

at worst another bike
If you want a lemon, have my bike, and i'll have yours
I guarantee you'd be be screaming blue murder,
and have an open line of credit to suisse bank....
