Looking at the above pictures, I presume you got the bike home noted the corrosion and regretted buying the bike ! and using the engine to get try and get ya money back ?

Out of interest how old is the bike, how long ago did you buy it, how much mileage have you put on it since buying and were the wheels in that condition when you bought it?
Would be helpful to put some context to your situation.

Oooo, I got my 2nd hand red GS LC TE from Benham and they didn't tell me it had had a new frame!! I only found out when my local dealer put a new engine in last June and told me that some of the engin/frame bolts were the wrong ones!!! So they looked up its history and found Bentham had changed the frame and one front fork.Strangely when my new gs wc bike went back to Benhams after I rejected it due to mis aligned frame issue that tried to kill me and I binned it, they had to reframe and rebuild the whole bike, I wonder if they told the new owner about its dodgy past ! I'm sure they did not because they asked myself not to disclose the reg details and the second one that started life with a light flywheel engine and ended up with a new heavy flywheel engine and still had issues.
Thats why I now ride a KTM

If recovered then the bike is worse significantly less as the id has been changed and not declared by dealer
Ins Co could view it as a 'ringer' with no paperwork given to owner at time of sale

Impossible. But I agree that what has happened shouldn't have. Take it up with the dealer.
As much as i'd champion the underdog fervently, in this case, i'd hazard a guess its not going to go the way you want.
At best you may get a goodwill gesture from the dealer,
A refund, highly unlikey,
You would need to present a robust case with any one of the consumer acts, demonstating the case against the dealer.
There is nothing i can see from yourside, that fulfils those requirements.
If anything, the dealer is going to show that you are materially better off.
So he made a paperwork mistake - been there done that, bike stolen & recovered with wrong plates fitted by the dealer
Bike not as described (trade sale) - turns out that dosen't apply either --- again been there and done that.
In both cases, i got nowt - if anything, I'm out of pocket ... and yet life goes on ...
do keep us up to date with your dealer dealings though , i reckon this could get to 10 pages then

Buying a motorcycle for cash is madness.
You need to realign your thinking as you get no protection.
I always buy my vehicles on Credit Card or Finance from the showroom.
I then pay off my Credit Card at the end of the month. So owe nothing, but I then gave Consumer Protection from the Credit Card Company.
Same with finance, but always check they dont charge for credit or early repayment. They then have a legal invested interest in the vehicle and you can leverage their legal team to help you. Repay the loan early whenever you want.
Paying cash is the weakest position to be in.

So they did you a favour by replacing it?

A dealer who keeps their Demos for 3 years before selling? That's not going to ever happen and as already been said. That would've been on the old original engine
I'm interested to hear how you found out that your bike had received a replacement engine?
Speak with credit card company Section 75 team and explain your situation. See if they can help? But it's a long shot.
There might be a case of Breach of Contract from the dealer under the Sales of Good AND SERVICES Act.
The dealer has to provide reasonable care and skill or might be in breach of contract under the 'services' part of this act.
If it is found they are in breach of contract you may be able to use this for a total rejection of the deal.
This will be a fine tuned specialist legal position I think.
Hang on, hang on... Who was the registered owner of the bike when the engine was changed ?
It's up to the owner to change the details and inform the DVLA.
If BMW send off the logbook to change the engine details then another owner would be added unless the logbook is sent back to the previous owner........ and believe me (i'm talking from experience) something as simple as forwarding on the logbook to the dealer is way beyond a lot of peoples capabilities.
