Sale or return?

Hi guys,

I've had some health issues (heart) recently and decided to let my local dealer sell my 2016 R1200GS.

This was a 30 day SOR contract.

After a week I changed my mind and took the bike back.

While cashing in my roadtax for me, they managed to unregister me as the owner!

DVLA has said this will take 6-8 weeks to sort out, and I can't tax or ride it in the meantime.

It will also add another owner or two to the logbook.

BMW have fobbed me off saying it's normal practice for SOR. I find this hard to believe and was after some advice?

your own words "30 day contract" you broke the contract live with it,you would be moaning on here if they had broken the contract nest pas?
 
Did you instruct them to untax it?

They should have foreseen that they might not sell it, and have to return it to you, and therefore maintained its status, I think.
 
Surely your local dealer should only be notifying DVLA when they have bought the vehicle either as a registered keeper or motor trader? As it was in a sale or return basis they should not have notified DVLA . :nenau
 
Dvla does not take 6/8 weeks to sort this out, and you can retax the motorcycle, having been in a similar position in the past, you have to write to dvla explaining the situation, they can if they deem fit, swap your details over, and not add extra owners, however you entered a contract, like it or not you asked a dealer to sell your bike. I would guess a dealer would need to change the owner of the bike, as for example how would someone be able to test ride the bike on a dealers insurance.
 
maybe if a customer wanted a test ride on it before buying/financing this would be the standard needed for company's insurance/finance agreements to be met?

Always read the small print, we only learn by our mistakes. :blast

The V5 is not proof of ownership just the registered keeper. the contract was for 30 days and if they had not sold it within that time the owner would get it back. I do not know the small print of the contract but Sale or return implies the dealer is selling it on behalf of therefore the V5 change is IMO wrong

The service bods do a test ride on a bike after they have done work on it for whatever reason and they dont change the V5 for that

I realise I am quoting your post but not with the intention of causing an argument

Be a bit thankful you got your bike back.

I left mine with a dealer (not BMW) on a sale or return basis some years ago. Dealer went bust and I never saw the bike again, nor any money after the big creditors and Administrator had taken their share.

My advice, for what its worth, is never leave any thing on a sale or return basis.

If you wanted the tax back they could've just SORN'd it then let it go out on demo on their trade plates

Not that shower in Market Harborough was it? They went down with dozens of people’s SOR bikes in the shop and plenty sold but before they paid out to the owners. Midlands Superbikes IIRC. Think the person behind this was being investigated for fraud and threw the self off the cliffs at Beachy Head.

Yup, they were the culprits. Had been there a fair few times so no reason to believe they were thieving bastards but should have done some homework before hand. Seemingly the owner had done the same thing before darn sarf when he traded as Cat bikes.

Police totally lost interest in the case when he jumped even though the sales staff where involved. Surprising because I understand some Police staff lost their bikes.

As I said steer clear from sale or return.
