Sticky exhaust flap - Claim under used bike warranty?

Picked up a 2013 R1200GS LC on tuesday which came with full 2 year BMW premier warranty. A fuller inspection today has shown the exhaust flap to be sticking. Do we reckon this can be looked at under the used bike warranty or not? The dealer I bought the bike from is 120 miles away so probably looking to take it into my local.

If not it's hands dirty time and I will sort it myself as doesn't look like a big job.
 
If the BMW dealer had checked the bike over, ie full diagnostics, this fault would have shown. Ring your supplying dealer and ask them

Yeah that was my feeling, should have shown up if they had scanned it so obviously weren't interested in sorting. Have stamped the book as having just done a full service so I will ask the question.
 
I had the exhaust flap replaced under the used bike warranty so why wouldn’t you just mention it to the dealer you bought the bike from
 
Took my 12 month GSA in for a service, When I collected it, They told me they'd changed the headers as the exhaust flap was sticking. Couldn't believe it, Brand new shiny downpipes !
 
Tried to claim on the Approved Used Warranty on my 2014 in August... Not covered.

As you bought your bike this week check out the consumer rights act 2015 as irrespective of what the warranty says you'll have a claim against the dealer

I had a similar local dealer disinterest, when i had issues with my FFF, the dealer i bought it from was also 150 miles away

I told them is they didn't want the work, that was fine, i'd just contact BMW customer services to let them know and take the bike elsewhere

they soon changed there mind and the work was carried out within a couple of weeks

Changing the design on the WC bikes, so that fixing the flap involves replacing the exhaust pipe, must have cost £00000 s in warranty claims, such a stupid change.

I too had my exhaust system replaced under used bike warranty (2018 1200GSA) discovered during a service by Vines without even having to ask. Apparently the cost would have been around £1,200. It’s amazing they haven’t come up with an alternative solution as they must have replaced a lot of them. It’s a basic design flaw.

May or may not be right but I queried this question with a dealer not long after the wc models came out and was told it was forced on BMW to make it more difficult for owners to delete the flappy valve themselves (as many did on the hexheads) thus effecting noise and emissions

Makes sense.
If / when My flap fails ill just fit the headers without the flap..... Or if its stuck open, as it always seems to be, Ill just leave it.

I wonder if the MOT will pick up the fault. I assume if they don't rev the bike past when the flaps open you should br ok?
 
Good point. Its first MOT is end of March. My dealership will do the MOT at the same time as its service. Will be interesting as I did mention a light squeak when it was still in warranty.
 
Nothing to do with an MOT,

Emissions aren't checked, and its only for noise reasons tbh.

Sorry Sir,they all do that! Seriously, everyone of my mates with WC 1200 and 1250 bikes have had this issue and everyone has gone back to the dealer to rectify it. It seems to be a very common issue, but no doubt, you could sort it out yourself at risk of invalidating the warranty.
 
Relates to a hex head. But mine was replaced during its first service ( with me) by my local dealer and just told to me when I collected it. It was 7 years old at the time and covered under BMW approved used warranty, I didn’t buy it from the servicing dealer, but they were great and have been ever since.

It’s went on to stick again, but I’ve just left it as is stuck open.
