Interesting reading to be had there....I don't think that I have a case (not that I was necessarily looking for one) on the grounds that I didn't question the dealer at the time of purchase about whether the bike had been an insurance write off or had any accident repair work done to it.

I can live with my own faux pas on this occasion and will hopefully learn from the xperience about future purchases of such significance.

As for the comment about my post title.....fair point....was probably just trying to make it more attention grabbing...but implications of these accepted...err MODERATOR can you drop the 'duped' - apologies

I had a similar experience when I purchased my second hand (Less than one year old) K1200s from a large dealer South of London in Jan 2005.

When I enquired as to where the bike had originated from I was told that it had been a "BMW Staff" bike.

Perhaps wrongly I accepted this to mean a BMW company machine (In the same manner as a company car, that is it had been used by one company employee) and bought the bike. Not long after I had to have the clutch replaced under warranty followed a few months later by the front discs.

Turns out it had belonged to BMW Promotions... It had been used as a Press machine (I spotted the bike in a late 2005 edition of BIKE magazine) and had doubtless been ridden hard in its short life before I got hold of it.

I considered going back to the dealer but decided against it as I wouldn't have been able to pin anything concrete on them (At no point had I specifically asked what the bike had been used for and I hadn't been misled as such).

Like you this soured the ownership experience for me despite a different BMW dealer fixing the problems for me under warranty without fuss. I decided to Part-X it for my current steed, my 1150RT, and I've chalked the whole thing to experience.

That's my take on it. Ultimately only you know what course of action you need to take.

This is a 5 - 6yr old bike.

The spraying may have been done five yrs ago.

In reality I doubt if you will find a bike of this age with no defects and the dealer is not going to point out every scratch, rust spot etc. If you are so pernickity - then I am surprised you did not see these issues in the showroom. The dealer will probably remember the amount of time you took looking over the bike.

HPI - does not inform you if the bike has been repaired - just just shows if the bike has been written off - be it Cat D or C etc.


You have to weigh up what you paid against what you feel it is worth. By all means go back to the dealer and ask - what can you loose - but I do not expect they will actually do anything.
