I had just had my 1300GSA serviced at BMW’s flagship service centre I mentioned to the reception that the headlamp was not secure and they said they would look at it. It felt like the adjuster had failed and seen as the bike has no evidence of any damage or knock’s that they would inspect the fault under warranty. BMW refused to entertain the fault because I had a aftermarket headlight protector installed. They offered to look at it for an hours labour. Turns out upon inspection in my own workshop that the adjuster was not installed correctly at the factory. Beware to remove any aftermarket products if you need warranty work.

you should fight them on this - the bike was built faulty and they refused to undertake appropriate warranty rectification work - a bit of plastic you fit on your bike has nothing to do with their fault and is not a valid reason for them to wave their obligations

take them to court for failing in their duty of care - bike lights are bad enough - wobbly ones are dangerous, we don't need wobbly ones causing deaths on the roads

such drivel where they try to get out of their legal obligations are outrageous - well done for posting on a forum so the world can see what kind of manufacturer they really are, and how shoddy / criminally their service centers behave

Duty of Care in Vehicle Servicing

Garages indeed have a duty of care when servicing your vehicle. This legal obligation requires them to perform their work with reasonable skill and care, adhering to the standards expected within the vehicle repair industry.

Key Responsibilities of Garages

  • Quality of Work: Garages must ensure that repairs and services are carried out to a standard that is acceptable in the industry.
  • Use of Parts: Any parts used must be of satisfactory quality and fit for the intended purpose.
  • Timeliness: Repairs should be completed within a reasonable timeframe.

Your Rights as a Vehicle Owner

If a garage fails to meet these standards, you have several rights:

  1. Right to Rework: You can request that the garage redo the work if it was not performed correctly.
  2. Price Reduction: If the service was inadequate, you may be entitled to a reduction in the price you paid.

Steps to Take if Issues Arise

If you encounter problems with the service provided:

  • Communicate: Discuss the issue directly with the garage to seek a resolution.
  • Document Everything: Keep records of all communications and receipts related to the service.
  • Seek a Second Opinion: If necessary, obtain a report from another garage to support your claims.
Understanding these rights and responsibilities can help you navigate any disputes effectively.

I bet you’re fun, on a night out

There's so many details missing in the original post, it's impossible to tell exactly what's being talked about. There's no way to tell how this aftermarket headlight protector is installed. Also you absolutely can't take the bike in for warranty headlight work without removing the aftermarket headlight protector yourself. All this would appear to be a problem caused by the owner.
