Just getting my head together after a bit of a big smidsy. Absolutely her fault, turned right straight into my path. Bike's annihilated, I've got two broken hands - one of which is now made of titanium, and a broken foot. In all I think I escaped quite lightly but thing's have to be sorted out. Carole Nash have put a solicitor in touch, covered by my legal insurance but I've no idea whether they're any good or not. Just looking for any thoughts and advice really...

in 1992 I had a huge one ,myself, called Macenzie and Chester down in Exeter, the entire thing was handled over the phone by them with sending me to specialists etc. Eventually they got me a good pay out, they used to advertise in all the motorcycle press magazines at that time and were the only ones I knew of doing it back then. Nowadays everyone seems to be doing it.

I'm sure they'll do a reasonable job. Make sure you keep a record of everything and keep every receipt pertaining to your out of pocket expenses. Nobody will give you compensation because they feel sorry for you. If you can't prove the expense you won't be compensated. Don't expect anything for at least 12 months even if it's not contested and don't except the first offers.

i had a prang, car turned right in front of my path. bike written off, not only did i get a good settlement for bike (more than i expected) but they even got the balance of my years insurance paid. physio all paid for, loss of earnings all paid for, i got full retail value for my leathers, helmet, boots,gloves etc. despite them not being new -

this company have been dealing with BIKE ACCIDENTS (ONLY) for years - there service is absolutely exceptional. the 3rd parties insurers didn't fight a single point raised by "R.S.S." and the claim was setled in a very short period of time - all this despite the 3rd party claiming it was not his fault.
 
When I had my biggy, almost 3 years ago now, Carol Nash tried to fob me off with a "no win no fee" company but I complained very forcefully as I had paid an additional premium for legal cover and they then got Irwin Mitchel Solicitors on my case.

Everyone at Irwin Mitchell has been great, they've change it from being 100% my fault to finally agreeing that it was 75% her fault (it's always a split no matter how definite blame appears, particularly with bikes and roundabouts as was my case). They're now building the claim into ££, it'll take a while but I'm not bothered they can take as long as they like.

If you get Irwin Mitchell I can thoroughly recommend them.

my case was also on a roundabout car / bike - blame was 100% aportioned to the 3rd party.
 
Irwin Mitchell

I had a SMIDSY a few eeks ago, bloke at the time admitted fault but, surprise surprise his sols are now blaming me. Won't bore you with the details, other to say that not only did he pull out of a side road in front of me, he then did a u-turn to make absolutely sure he got me, but HE is using Irwin Mitchell. I hope they've gone downhill recently.

My insurers - done through BMW Motorrad - have put forward a firm named Shoosmiths to represent me. Anyone got any feedback on them, please? The other guy's case is peppered with inconsistencies, and I'm beginning to think he has simply lied about the details. With no witnesses, though, it may be his word against mine in court.

I was very, very lucky to just clip the front of his bike and damage sliencer and rear frame. 6 inches forward would have smashed my left ankle, if I'd have hit the side of his car I doubt I'd be here now. Anyone know the likely cost of replacement rear frame (by main dealer)?

solicitors generally

I'm a solicitor who also rides a bike but this is not an advert!

Shoosmiths and Irwin Mitchell are both respectable-but just bear in mind that firms of solicitors who are acting through your insurers tend to be claim factories, so yours is likely to be dealt with by a clerk or legal executive, not a solicitor. They are also likely to be on the other side of the country, so going to see them to discuss your case is not an option. You do not have to use solicitors appointed through your insurers if you dont want to-you can use one you choose if you wish and there are obvious advantages to doing this, especially if they ride a bike as well; drivers dont tend to have SMIDSY's, but anyone who rides a bike has either experienced one or come damn close.

There are a few firms who advertise in the back of the magazines who specialise in bike accidents, and I'm always happy to help a fellow GSer with a legal problem.

Thanks for your inside information! Can i change solicitors mid-course, or will insurers get the hump? I'd like to use a specialist firm if possible, especially as I believe it's going to get dirty. Also, I've had no response to a couple of letters from Shoosmiths, and telephone calls only put me through to voicemail.

thanks for the wise words, I must admit the letter I was sent made me feel that I was just a number to them but I'll have a good read through their bumf anyway. Thanks for the tip about choice David, I might give you a shout when I've had a think about things.

In defence of Irwin Mitchell, I do have a solicitor working on my behalf who I have met (in Birmingham) and I also have regular contact with the barrister who is dealing with my case.

I have seen numerous specialist, including one in Harley Street and one in Liverpool who is regarded as the world leader in his field (according to yet another specialist) so at least I'm getting the best medical attention that's available, anything else will be a bonus, I'm happy.

you can certainly change sols whenever you want-there may be (inevitably) cost implications though. i suggest you give one of the specialists a ring and talk it through with them and they will give you the options.
 
Shoosmiths delivered for me when I was knocked off in London last year, having said that it was pretty straight forward and the other party was the Met Police.

I am using Clarke Wilmott (also via Carol Nash) to deal with a more complex filtering claim at the moment. Thay have just issued court proceedings against the other party. this has been going on since April
