I've rejected my bike can anyone recommend a good solicitor .

Yes you are correct in someways what you don't no does not hurt you so if there was washers fitted on collection i would not of questioned it as my varios would have fitted but i may have questioned why 2 washers one side and one on the other ! but your missing the point why is the need for washers, as other bikes don't have washers and the vario's fit ! Because BMW made a fook up and rather than spend £££££ putting it right there bodge is washers and they don't look right .

BMW rejected my claim for my vario's so i rejected the bike not fit for the purpose i brought it for ie touring being a TE (touring edition ready for the fitment of vario panniers) i did not expect to pay 15k and have to have rusty fooking washers 2 on one side and one on the other because the subframe is out of tolerance if its ok for you than fine but not for me.

No probs fella, that on its own wouldnt bother me, then again i wouldnt chuck £15k into any bike and if i had i might feel different, to much money imo but each to their own, spending that sort of money they should go out of their way to sort things out.:beerjug:

Yeah sirich i agree 15 large is a lot of money especial when i paid in full it kind of hurts more when its not right and no one at bm is taking notice, i than thinks i should have took the finance option and gave bm finance the hassle but the end result is exactly what I wanted from them in the beginning so I'm ok with it tbh and I still have faith in my dealer they took it upon themselves well Andrew did to contact the person with the power to overturn some numpty s decision and in return ill stick with the dealer for future years and buy again.

Are you having trouble with the "full stop" button on your keyboard? :thumb2

I keep seeing this "fit for purpose" term being bandied about as grounds for rejecting a motorcycle (or indeed any other goods you have purchased). Please bear in mind that "fitness for purpose" is only relevant if the purpose in question was stated *before* the deal was done.

i.e. in this case the buyer must have told the dealer that he wanted to fit Vario panniers and go touring on it *before* signing on the dotted line.

I don't think you can rely on the "TE" model designation making any specific claims about the bike's suitability for fitting Vario panniers (or even for "touring"). There is a long-standing tradition in the motor trade for applying acronyms such as GT (Gran Turismo) when in reality it designates nothing more than a trim/equipment package. Such acronyms make no claim as to fitness for specific purposes.

I left my dealer in no doubt we needed the luggage to tour in September, that's tank bag and panniers. He won't be able to deny it!

well, well - I linked this post with a warning to my Saffer friends..... and needless to say the "expected" poo-pooing happened with people that are so brand-loyal that they refused to believe there could possibly be anything wrong with the design of the new GS......

but patience and reward comes to those that wait!

......... this morning I noticed one of the stalwards of our DS rider clan in SA posting this:

I have picked up a problem with my steering on what feels like a serious instability or headshake what every you want to call it. Try the following, close your throttle on about 80km/h and hold your handle bars very lightly. My LC develops a serious headshake that quickly becomes a Tankslapper, personally this could not be normal?
Have done a long trip over the weekend and had lots of time to play around with all possible mode settings and tyre pressure and nothing made any difference to the issue. All that I think that it could be is a tyre problem. I have the Tourance tyres on the bike with about 2400km on .

Anybody else experience this?

just feedback for your case............

Hearsay is not evidence - anyone can make up any old crap for all sorts of reasons and try to pass it off as evidence - it's called gossip and tittle-tattle, it's what old women do because it is entertaining for them but bears no connection with reality.

Done the same NO ISSUES

Even taken my hands completely off the bars for about 100yds (on a private road of course) - slight waver but did not make my pulse increase at all.

Personally I think all this talk of tankslappers is a load of crap or the incompetance on the rider

No mention of having had the wheel rebalanced? :nenau

wheel balance

No mention of having had the wheel rebalanced? :nenau

Hi all Talking of wheel Balance, I have the Enduro model with wire spoke wheels I have covered 3500 miles with no problems, not even a speed wobble,
my bike has no balance weights on either wheel. are all the spoked wheels on your bikes minus weights.

Agreed - or bike overloaded, tyre pressures incorrect etc, etc - it is amazing how incompetent some perfectly normal people are when it comes to things mechanical, it never ceases to amaze me just how weird some peoples' minds are - some people really do not have much of a clue and shouldn't be allowed near a motorcycle.

the fact that so many mentions are made that the rider is to blame or incompetent is actually laughable!

So what I understand is that, THAT statement would also imply that Kevin Ash was incompetent , did not have a clue either...? :blast

My personal bugbear is the use of petrol station air lines, the gauges get thrown about all day, how can they possibly show an accurate reading. By all means use them but check with a quality pressure gauge.

Given that you created a written contract when you signed the order, what you said to the dealer would not matter unless you added it to the order terms and conditions prior to signing.

Has the cause of the Kevin Ash accident now been published? I would appreciate a link if you have one.

WTF has Kevin Ash got to do with it? No one knows what the cause of that accident was yet, so don't be a dick and assume that you can deduce the answer from the spec of next years model.

I would also add that the vast majority of motorcycle accidents where no other vehicle is involved (and there are plenty of those every Summer) are the fault of the rider - so the competence of motorcyclists leaves a lot to be desired.
