Almost as if the weight of the brake pedal was too much for the return spring. so his brake light was flashing all the time dependant on the road surface

Well i aint no Engineer but when you press the brake pedal down with your hand, you can hear a click in the master cylinder, maybe that is the sensor in there, and you cannot see it, just a thought.
