Esa replacement

Anyone had an esa rear shock replaced by bm under extended warranty.
Ive a 09 gs with 22000 on the clock and although shock isn't leaking, still damping well,the spring is sprung out.

Isn't that a fair wear and tear item?

I'm not sure I'd be claiming for a manufacturing defect after such a mileage......
