HELP re R1150 GS Bevel Box bearings !

Sorry to shout but as a matter of urgency I need any info from members who have had bevel box bearings fitted which failed after a relatively short time.
Mine were replaced by a BMW trained mechanic at 23,100 as a precaution and the larger one failed less than 800 miles later. BMW technician in Austria stated they were fitted and shimmed correctly and that there has been a batch of faulty genuine bearings .
This cost me £200 to get going again BUT the diff is now U/S due to excessive wear
Problem is that my local dealer who supplied the parts M*** are saying that there is no warranty on the parts because they were not fitted by them and that they've now LOST the offending bits so I cann't have them examined independently.
Any help grateful as I want to confirm that there is a problem before I contact my solicitor re sale of goods act.
The mechanic also had a second one fail at the same time that had only done 600 miles and it was replaced by BMW but there was no damage caused on this bike as it went on a local run not at 90 mph on an extended Autobahn run.

Your on a 'sticky wicket'
the dealer who sold the parts had no control over the fitting of them and will say its not his problem, if they had been done by the dealer then yes you would have had some come back.

But if you paid someone else to replace the bearings then you should be looking to him first for replacement, as your solicitor will tell you, your contract was with him ( ie you paid him money to provide the service) ,and he in turn should be looking to BMW to claim

The parts should be of merchantable quality if they are not then you will have a claim, at least for the parts .not sure of the consequential damage /
An examination of the bearing would have pointed to the root cause of the failure , but you say the dealer has lost it, thats handy for them , now you have nothing to support your case
Save you money write it up to experience
Ask Steptoe if he has heard of the batch of faulty bearings , that may help

You have two options:-

1. The parts were defective from new, in which case redress from BMW

2. Or they were fitted incorrectly, in which case redress from the person/company who fitted them.

However with the best will in the world without the actual parts you are never going to prove either to anyones satisfaction. All you have to prove is that on the balance of probability one or the other was the case, but I would doubt you have that.
If you have legal assistance with home insurance/bike/car/AA/RAC or similar you may be able to get some advice.
I really think that you are going to just have to swallow this one though !!!
 
My mates 1150 adv has had 5 in 50,000 miles :eek: also 4 were fitted by bmw dealers, we fitted a s/h final drive in the end as there must be a problem with the unit, also told not a shim problem but i am not convinced been fine since
