Folks, I'm trying to potentially save the mother in law money. She is recently widowed, estate in probate. Dead husbands car tax needs to be payed. She can't declare it off the road until probate is completed. Can she sign the forms stating the car is off the road if the car is not in her name? It's a big car, tax is expensive... Thanks.
 
Does she have the V11 reminder or the V5?
If so, shouldn’t be a problem.
Just do it online.

AS long as Its in a Driveway/garage off the public highway SORN'ing it is fine
 
When the car is changed into her name she will only be liable for tax going forward . Back tax is null and void. If you want to confirm this phone local motor tax office they are always very helpful.

Republic has now moved to a declaring off road thing quite similar to the U.K. To answer the question strictly speaking she can’t declare the car off road because she is not the registered owner. But fear not because whoever becomes the new owner will not be liable for any arrears. Hope this helps. JJH

Good me!. That's good info. Didn't find that online but perhaps I wasn't looking in the right place. I'll report on and call them in the morning. :thumb
 
There is probably correct form and a procedure that is applicable to your mils circumstances but what I have said will work. She could also sign his name but that could bite later. JJH
 
Owen had to do this with my mum's car. Once probate is completed the solicitor will then have the vehicle licensing form completed in your mother in laws name, once that's done as JJH siad all previous liabilities to back tax will become null and void.

You just hit a nerve. Ow.

They have chosen to do probate themselves. To save a few quid. I have stopped enguaging with them to be honest. I don't agree with they way they are doing it and i'm pissed off with the amount of pressure and stress it's putting my girl under. Her mum has never done anything for herself. Never worked. Does not know how to change a light bulb let alone cut the grass. Anyway, thanks for the info, I've passed it on, it;s much appreciated.

Just change the ownership on the vlc form. Vrt office dont check, they just do the paperwork. Then the new owner declares it off the road.

It seems morbid but ive seen it done and it works.

The only issue might be if you declared it as an asset and by how much. In the case i seen above they got around probate by valuing car at 50e.

I did this when my uncle passed away, no problem, I am using a solicitor who agreed. The car was not counted as an asset.
