Why do people insist on turning the bike off with the kill switch. That is not how you switch the bike off under normal circumstances, it’s an emergency kill switch.

Don't usually use the kill switch BUT on my 2014 1200 GSA LC if you were in the enduro modes with ABS switched off you are told in the manual to use the kill switch to stop the engine , if you used the ignition switch it reset everything and when you started the ABS was fully operational and had to be switched off again

Maybe using the Kill switch just shuts all the power off - like not "officially and professionally shutting the ecu/computer down" that runs the bike.

Ok so some good feed back from you all Thanks very much i appreciated the all the response.
Seems i am not on my own when it comes to John Clark Hard work to put it plesently.
So BMW uk would not lift a bike from my house that has a fault as(I QUOTE) the bike can be started and riden to the dealer when i get my v5 form at my own convenience this is the responce from BMW complaints word for word.
TO be fair i dont normaly use the kill switch but on the first time i started the bike i used the kill switch as i wanted to change some screen settings which i finished in 2 min max.
After seeking some advice and some imput from your good selves sent the REJECT BIKE E mail.
Funny thing is the e mail was sent at 16:27 hrs today and after having 48 hours of all one way communication by me i receive a call from John clark at 17:15hrs regarding the REJECTION.
IT was pointed out to me that John clark do not PDI bikes this is carried out in a centeral base in England .
I was asked for the details of the motorcycle transport company i used DMT( James Higgens ) good bloke.
I am now thinking now i have got john clark attension they will use DMT to ship bike to dealer to get it sorted .
How wrong i was again the Rejection has been excepted and the bike is being picked up and away.
strange way to do business but I have had another life lesson today.
So now i will just have to oder another new bike from HURST and wait weeks on it and try again third time luckey i hope .

Both switches are just that, Current interrupters, on or off.

Except they're not the same because they interrupt different circuits. The main key turns everything off, whereas the kill switch just turns the engine off.

If you turn the key 20 seconds after you use the kill switch, I doubt the battery is going to be affected. And on an old bike, it probably makes very little difference. But on a new bike it leaves all the systems running - lights, screen, heated grips, heated seats, whatever - and if left for very long it will have have an effect on the battery. I have two biking friends who use the kill switch, get off, start chatting and frequently forget to turn the key.

Whether bikes should have a bigger battery to cope is another argument altogether.

Within 30 days of taking delivery/purchase of the bike whichever is the latter, the Consumer Rights Act 2015 states you can reject the goods if a fault is/becomes apparent. Therefore once you have intimated this as being your preferred choice to resolve the matter and put your intentions in writing as you did, then unless the seller can prove that the fault was present when you purchased the vehicle and you were aware of the fault prior to purchase they are obligated to accept the return of the goods.

The seller can apply a reduction in the refund for mileage done on the bike but this is not applicable in your case.

The seller has complied with their legal requirement on the basis that they genuinely had no choice. A good outcome for you.

Who does the PDI is not something you as a customer should be worried about! You paid John Clark for the bike, it is their responsibility to ensure that you get the correct product, fit for purpose and properly prepared.

Sorry to hear you've had so much difficulty though. Unsure why you'd order a new bike from a dealer in England, unless the price difference was significant. Good luck with your local dealer.

Just to put some of you out of your misery
This sale started second week of January on a one year old bike that John clark had for sale with 800 miles on clock ex bmw uk promopion bike.
This sale fell through for various reasons one being i did not get any pictures or video of bike 3 weeks after having agreed the sale not good sales i think .
I complained to motard and after some time i got offered discount if i would consider another deal
More fool me i opted for new bike and got good discount.
However this also has went sour.
local dearer has not got the selection of bikes that is on the Main land LOL
Think i have said enough thanks lads for the imput i realy appreciated the info you have got to love this form when you moral help it is freely given .
