Officially rejected another bike .

I'd like some advice and your general thoughts on this .

My 2014 bike that I've used for a period of 3 months following having its first serviced 26th April, than one trip in may and one trip in June when the water pump failed and several other issues @ 4000.
The bike was returned to the dealer whom stripped the bike down fitted a new water pump only to find it leaked again, stripped it down again to than find porous engine casings and it cannot be fixed, resulting in a replacement engine, I've turned this option down as i have no faith in this brand of bike anymore as there plaque'd by faults and this being my second bike. It has no resalability on the private used market, so they want to take the piss and offer me sweet nothing for the bike .

Ive sent a letter of rejection and this is what they have said .

Many thanks for your email. Your points are duly noted. I would like to clarify the options that are currently being offered to you as follows:


Option One - The first option to consider, and our legal obligation in such circumstances, is for us to fix your bike. It’s unfortunate that a repair is necessary, however, as with any product and particularly with a complex mechanical product such as a motorcycle, you should be mindful that faults can and do occur. It’s for this reason that a comprehensive warranty is provided by BMW. We will fit a new factory sealed engine to your bike at no cost to you under the terms of the warranty.


Option Two - As a gesture of goodwill by Benham and BMW, we can supply a new 2015 model year bike at a cost to change of £2,000 payable by you. This offer is time-limited and will expire on 25/08/2014, so please do not delay if you decide this route.


Option Three - As a gesture of goodwill by Benham, we can purchase your bike at trade market value once a new engine has been installed under warranty.


Option Four - As a gesture of goodwill by Benham, we can seek to acquire a used R1200GS and exchange it for your bike once a new engine has been installed under warranty.


We are askeen as you to resolve this matter and truly believe these options not only meet, but exceed our obligations. Having liaised with BMW today, a full refund is not on offer in the circumstances. Your bike has not, for example, suffered a catastrophic failure shortly after delivery. You've also travelled some considerable distance and so had fair use from your bike.

I hope that one of these four offers will be satisfactory to you. Please let me know as and when you've decided on your preferred route.
 
Doesn't sound too good to me

I dislike all the options and options 2 and 3 are a bit cheeky, seeing as your so loyal to BMW and Benham

Option 1 seems your best bet, but it seems like a no win situation to me and you're under the kosh either way....unless you want to throw another £2k at it again

You're going to get many opinions, and not one of them will be of any more value than they cost you (IE NOTHING)

Speak to the CAB or the Trading Standards people.......they are the only place that you are going to get a valid, legitimate and reliable set of options, and possibly support from the T.S people.

EDIT...FWIW, I'd close this thread and try and deal with it away from the forum first.......yes it will spoil the fun of the ranters, but BMW do read here and if this turns into a rant or the dealer gets a bit of a slagging, it won't do your cause any favours ;)

Once it's sorted, let everyone know one way or t'other :)
 
Well, from a legal point of view, sounds like they might be making you a good offer and 4 good choices?
 
Sorry your in this situation. I would take legal advice on this. It seems to me that as the bike is used with 4k miles on it, this has compromised your position. I wish you well
 
Option 3 is a corker translates to we will give you bottom book after we bill BMW loads of money to do the repair and then sell at top retails making loads of extra cash out of your misfortune.

Option 2 is the only one you just need to work on narrowing the gap

Option 5 your own option accept option 2 tell them you want it unregistered and crated and then sell just below normal retail as a new bike to get most of your money back
 
Im Sorry as this seems to be dampening you enjoyment of the bike..... Just remind me what is wrong with having a new engine?
 
Personally I'd go with option 2, try to narrow the gap to £1,500 and expect serving costs included up to and including 6,000.
 
Why are they liaising with BMW? It's not any of their business. You bought the bike off the dealer and it's the dealer who must sort it. They don't seem to have much faith in the resale value of their product going by the prices they are offering. And trade value? So they expect to make a profit on the deal. Hobson's choice with litigation so expensive. What other bike would you go for? If you like the bike except for the problems would you not go for option 2 and ask for a better deal as a good will gesture? Then you would have a new bike after all they aren't all bad. Good luck. Plenty of bikes have had a new engine through the years, I bought a used 1999 11GS a few years back that had had a new engine at 2k for a porous sump casing and the bike had over 60k on it and was as sweet as a nut

No doubt the 1st owner, 15 years ago....... was a bit pissed his bike had to have a new engine at 2k and a few months old...................but he obviously got over it and ran it until it was 3 years old, before selling it to the 2nd owner

Personally i'd have the new engine, then flog it for another brand

Who's to know and it'll cost you no more at BMW's table

It will not stop there, the issues i had on my first bike were horrendous, so have lost faith in 13-14 bikes and how comes a leaking water pump destroys the engine ! Because it was built by Chinese Fred in his shed.

Ask yourself would you buy a new bike advertised with a new engine ! And remember the difference, i would tell you the dealer will not.

I did offer £1000 contribution, but there adamant they want £2000.

I'm fooked off with it all now, I'm off on holiday 2mo could really do without all this shit.

Sorry about your on going problems, I would go for the new engine myself with option 2 as my second choice if they make the price better!

Hope you come up with a compromise

Hold on the engine was not destroyed by the water pump. The casings were porous although a leaking water pump could be the cause of a damaged engine it's not the way I read your post. JJH

As crap as it is, £2k is more than trade, as trade on your bike with no extras is around £11250, so you'd be around £850 up on a 2015 GS.

But, if it was me, as much as I like the GS, if I had 2 duds, I'd walk away from the GS, and go for something different. Like an S1000R.:green gri

All joking aside, if you fancy something different, and BMW don't budge on their offer, tell them you'd like the R, and it won't cost you a penny. And you would make some money back after you've sold all your accessories.:thumb
 
Cheapest option to me seems to be #1, and then part ex the bike at a non BM dealer.

Though I'd see what the non BM dealers part ex value would be to see if option #3 works out better for you.

What on earth makes you think the S1000 will be any better

I guess ignorance about the S1000 is bliss:augie
