Having been totally unimpressed with BMW Customer Services response to the failure of the fuel pump controller on my 2006 GS, I 'grassed them up' with a report to VOSA. To my complete surprise, I received a follow-up phone call explaining that my year model was excluded from the recall because BMW statistics did not inidcate a failure rate that was significant enough to justify action.

The only problem with this is for that riders whose warranties have expired get repairs undertaken outside of the normal BMW channels e.g. they just buy the part and fit it themselves. I'm not even sure that BMW log non-warranty claims for this fault.

Basically, I want a refund for the replacement part that I had to buy because the fault is just the same as that experienced by owners whose bikes have been recalled.

So, I was wondering if the factory fitted part number that failed on my 06 bike (it has two numbers 7694378 and 58200070) is different from those that are included in the recall)? Just for the record, after the failure a 16147719844 was fitted before I upgraded to the epoxy coated 16147720776.

Any help would be very much appreciated.

Thanks

Just out of interest how much did you have to pay for one ?

Had mine replaced by BMW International Rescue !

I bought a spare a month ago Baz! £67 with the promise of a refund when mine was recalled.
But again, have since been told my 06 is not included in the recall.:nenau

For the black epoxy coated 16147720776 I had a 'special' price of £60.79 inc vat. I still have the receipt but I'm not holding my breath for a refund: unless I can expose a BMW part number conspiracy. I'd love to grass them up to VOSA again!

And quite what do expect VOSA to do after you have grassed those nasty people at BuMW up again??

I thought the explanation was pretty clear and that your bike didn't need a replacement FPC even though there have been problems. Every component will have a % failure rate and I would guess VOSA are happy that BuMW comply with this in your case.

I take it that your FPC failed outside warranty and that is why you aren't happy? Lets face it it, £60.79 is hardly a kings ransom for something that failed out of warranty.

Probably because yours isn't in the duff batch so they aren't going to change a perfectly good FPC. But now you have a spare in case it does go which will probably be tomorrow:blast

Sgt Bilco isn't an unhappy 04/05/06 owner but many of us are. Perhaps start a poll and see how many of us there are, then send this to VOSA :thumb2

Not to sure of the exact law regarding this but there is law associated with design liability.

Basically what it means is that a manufacturer has to design and manufacture a product that is fit for the purpose it was intended. The liability for this is 6 years. Yeh 6 years!!!!!!!!

Hence if it can be demonstrated that a particular component has an in built design fault, the supplier is responsible for correcting the fault up to six years from the time it was sold. The supplier being the dealer as your contract is with the dealer.

However to take the dealer on with this you have to be good and you will also need a good laywer.

However it was done with Landrover a few years back.

Landrover Discoveries built between 1995 and 1997 had a problem with the dashboards. The top nearside peeled up after about 4 to 5 years. It was unsightly and no amount of glueing would get it to stick down. It was expensive to fix as it was 2 dealers in the dealers and a new dashboard top.

Some keen and knowledgable individuals took Landrover on and the case ended up on watchdog. The lawyers on watch dog explained the design liability law and that Landrover was responsible.

The next day Landrover issued a directive to the dealers to sort out all Discoveries that customers had complained about with the "sticky dashboard" as it was known.

My Disco was 4 years old by then, and it got sorted.

BMW have a problem with the fuel pump relay. It just needs somebody with some bottle, knowledge of the law and evidence to take BMW on (via a dealer).

I agree with Sgt Bilko, £60.79 isn't a kings ransom, but when the original part let me down whilst overtaking at 70mph (we're talking complete power failure here) it becomes personal.

Tim Cullis' latest statistics show that for pre-2007 bikes, 57 members from the UKGSER community experienced failures. And looking at the state of my FPC when it was replaced, I'm pretty sure it was water ingress due to corrosion, hence the new epoxy coated version.

So I'm now hoping to find out if the part number for the recalled bikes (2007 onwards) is the same as that for my original part. If so, questions need to be asked, or at least a nice letter sent to my new found friends at VOSA.

My March'08 GSA has not been recalled and the FPC is silver so I guess its only 2007 bikes involved. It's also swimming in ACF50.:)
