You dealer sounds like they are doing everything they can for you which is great :thumby:

Sadly, I know what the feeling is like when you lose confidence in a vehicle :blast
 
The current drain issue is common on modern vehicles, and usually fixed with software or a wiring/ component repair,over week or 2, 12 months is testimony to your patience,
Have confidence that others on here have succeeded in a replacement,, good luck , Roamer
 
Well they rang and want to continue investigating.

Told them that I wanted to reject it so suddenly the offer of a loaner is withdrawn, as BMW won't fund it.

Bike not rideable and at the dealer and the guy who will look into the rejection won't be back till 5 January (closed on Mondays).

So I said leave it till then then, still don't want it back.
 
Withdrawn??? !!!!

I would be warming up my legal team at this stage as they have been "investigating" for a year!
 
That's weird .... So the Service Manager, Sales Manager, Aftersales Manager and Dealer Principal are all away until the 5th January?
 
As it is a company bike, needed for company business, you may need to consider hiring a replacement, which cost will be added to your claim when you take them to court.
 
Or the alternative (if the bike was recovered by BMW Assist to the dealership) is to ask BMW Assist for a replacement vehicle whilst your is off the road. Enterprise will only provide you with a car, but this should be sufficient enough to focus your dealer's attention on the job in hand, as they will only get a 48 hour window on the car hire before BMW or the dealer start picking up the tab for the hire :augie
 
Think Monday morning I would be on the phone to my legal team and get them to talk to BMW HQ.
Bypass the local shop as they are now on a cost cutting duty to themselves and are not interested in your BMW experience.
Explain to BMW HQ the response from the local shop and let them explain the National BMW view of customer care and after sales service.
I would also get your legal team mention the withdrawal of the loan bike and explain you will have to hire another bike as a replacement and charge them for it as its a business asset for your company.

Don't think you have much to loose tbh going forward, And by the legal eagles getting involved they will know are not standing for the dealer B*llsh*t.

PS you could always ask BMW HQ to deal with the local dealer now as you have no faith whatsoever with them after the last conversation ?.:blagblah
 
Trying not to name and shame really but really tempted.

Solicitor also now on leave till 4 January.
 
The complaint is with the dealership NOT BMW. When you buy anything it's with those who took your money... not with the manufacturer. Do not allow the dealership to absolve their responsibility by getting YOU to contact the manufacturer. This is your right, if the dealer comes up with the "It's Our Policy ...." line ignore it and continue to hold them responsible. Also, if the bike is on BMW Finance contact he finance company immediately and explain the situation as they are liable too under their terms and conditions and WILL contact the dealership and ask for their side of the story. The dealership rely on the Finance company for the bulk of sales, getting them involved where applicable is essential.

Also note. The Small claims court does not require you to employ a Solicitor.. that's the whole point of SCC it's to expedite issues like this without you spending a fortune on legal bills however there is a fee:

I rejected my bike via my dealer in 2013, and it was very straightforward. No need for lawyers or courts, BMW just replaced the bike for a nominal contribution towards the 6000 miles I put on the bike.;)

By all means get BMW involved, but do not bypass the dealer, it is they you entered into a contract with they have a legal obligation. Stand your ground on what you want and insist on a full history on headed paper of all the times it has been in for the same issue.

I keep thinking maybe I'm over reacting as it should be something simple to fix, once found.

But twelve months without a resolution and I'm beginning to wonder just how seriously this has been taken by them?

And bikeless is really pissing me off.
