Just incase there are any others out there that are having problems with their Ipods.
I have just popped in to see my local Apple Store and explained that my 3rd gen Ipod was playing up, specfically I thought the battery was dead, discharging too quickly resetting my preferences.
No problem sir, for $60 we will replace the battery.....okay that sounds ok I thought. Actually what they then did was go out back, pick a BRAND new Ipod the same as mine and swap them out.
So I have a brand new Ipod, may not be the most upto date, but hey....it's new and all for $60.
I'm happy.
(Also they still had me living at my old London address, still no issue)
