Long Tail backs and Solid centre white line.

I am led to believe that there is case law setting a precedent, where a court has decided that passing a queuing stationary vehicle by crossing a solid line is an offence.
My personal opinion: you'll likely get away with it provided you do so safely and without conflicting with other road users & you know where you're going to re-merge with the queue without starting a dispute. Don't do it past any junctions or lay-by to your right or you're asking for trouble.

Your circumstances were a little different Ian (!) but, yes, I agree with you about the whole dash-cam thing; you really do have to think about what you're doing nowadays...

FWIW, and until somebody shows me some caselaw that proves otherwise, the exception of passing a 'stationary vehicle' allows the possibility to filter on a motorcycle but only if it's safe to do so. I've never seen any further clarity on the definition of 'stationary' for the purposes of this bit of legislation and so I think this is open to interpretation. Clearly if you decide to filter, you're going to have to have it in the back of your mind that you could end up having to justify your actions at a later date. And it obviously goes without saying that if the line of stationary vehicles that you're passing starts to move, you definitely do not want to be on the wrong side of the solid line!

You can’t do where the law permits.

Coppers especially some traffic think they know the law and they don’t.
They learn policing not law.

We were stopped by a traffic cop for doing it. He got the we are permitted and told him how. He disagreed, told him well write the ticket and be on your way and the court will decide. He didn’t bother.

There is still half a traffic department in my local force area who think it’s illegal to hold a mobile phone while driving.

and there are catch-all offences for drivers who are seen driving along 'just holding' the phone by way of either some sort of bizarre legal challenge or that they need a comfort blanket to hold whilst driving. It's called "driving not in proper control of a vehicle" or even careless/dangerous driving, depending on the circumstances.

One click was all that was needed to remind me why EPG_19 is on my ignore list.....
 
I got done for filtering past stationary traffic with a solid on my side. Even though traffic hadn’t moved in 10 minutes.
I got a ticket then an ‘invite’ to a bad boys club for half a day. Thereby proving it’s an offence, regardless of what the less enlightened amongst us think.
The most embarrassing part was when I walked in to the bad boys club my recently retired police driving instructor was the trainer that day. That was me in the barrel for the duration :blast

No that wouldnt meet the points to prove for those offences.

There has been many stated cases of not guilty for just holding the phone.

So youre talking shit.

As you could be in proper control of your vehicle while phoning the emergency services, while holding and using your phone.

See the way the law works. Just because you think it should be law, doesnt mean its. I hope youre not a copper, but it would be typical

Its only an offence because someone thought it was and you didnt have the balls to fight it.

When I got the NIP it stated the laws had broken. Perhaps you didn’t get prosecuted because the policeman didn’t want to pick on a special needs child :augie

No it asks for your details. Then you get the offer, then you say fuck off i havent committed an offence and you challenge it at court. Unless youre a fanny and just roll over.

Then get found guilty, big fine. Prosecution costs. Victim surcharge and points on licence.
Perhaps someone with your outlook on life would challenge it, but most grown ups would shrug shoulders and take it on the chin.
I’m not certain, but I think it’s an absolute offence ( if that’s the correct term) so there’s no defence if they have evidence.
