Rejecting a Bike

As the Sale of Goods Act or Consumer Rights Act gives me the opportunity to reject a product if the retailer failed to rectify the defect after one attempt, what are the chances of me rejecting my 2014 GS LC?

The goosed rear shock is the straw which breaks the camels back, but as they had one attempt to recitify the defective engine paint and the replacement engine, which was fitted in May, is now also suffering the same signs of corrosion, I'm now at the point where I'm going to try to reject the bike.

I reported the shock absorber during the warranty period when it was temperamental, but they couldn't a fault. I'm damned if I'm now going to pay £1500 for a replacement after 15k miles :mad:
 
Surely a bit of corrosion doesn't mean the bike isn't fit for purpose?

Have you owned it from new? If so, rejection will not be easy. Owned for more than six months then it's a tougher game than if you'd just bought it.

I reckon you've almost no chance of success if you've owned from new.
 
You may struggle to reject the bike now but they may listen at the dealer and do you a good deal on a swap...quite whether you'd want a swap is another matter

But they will have the fact that you reported a fault within the warranty period recorded on the relevant job card

Rejecting the bike after 2 years of ownership? ......... you have no chance !
 
Surely some nice cheap used ones will be on the market soon. My 1150 has more than slight corrosion after 80,000 miles

The law is six years, not a notional two years warranty period.

The goods have to be of satisfactory quality. BMW acknowledged they weren't by changing the engine, driveshaft and bevel box in April/May. The fault has now reoccurred, so their fix did not work.

I work in QA for a global corporation, so I know a thing or two about these things ;)
 
I tried to reject my GSA LC after 16 months and I was the second owner (bought from the original supplying dealer). My rights were not diminished in any way according to the Consumer Rights Act (replaced SOG in 2015). The dealer will do everything they can to stop an official rejection as the precedent will cause them real issues. I pushed hard for rejection but in the end settled for a PX plus cash (went for the superior TC) that saw me not suffering financially as a result....it depends what you want to achieve. If you want your money back I think this will be a tough battle.

My brother in law being a solicitor suggested that the replacement parts, "having failed again meant that there was no reasonable prospect of a permanent solution unless the dealer was prepared to guarantee (not warranty) that the resultant fix would mean the bike is of merchantable quality".

The letter did the trick....fortunately all I wanted was to have a GSA TC and be put back into the financial position I was in previously had I not bought the LC. Note, this is not the same as a full refund. Therefore, it is possible an outcome could be to swap a bike of similar spec and age.

This is by far the preferred routs as if you reject the bike after 6months the burden is on you to prove that the goods were faulty from outset. You will need expert opinion to do this. In addition, the supplier is allowed to make an "appropriate" deduction for use of the product.

The calculation for the deduction is not set in law and many dealers will use book price where infact they should use forecourt price. There is a case going through the courts at the moment that will set this precedent.

My BIL view was that there had been so many issues with corrosion and publicly documented issues with suspension that it would be difficult to refute manufacturing defects at outset BUT you would probably still have to go to court. Risky and expensive.

The other point I would make is that when I raised this issue with the dealer they said they would refer to BMW for consideration. Don't be fooled by this, it has nothing to do with BMW, the responsibility lies with the supplier not the manufacturer.

A complet PITA but was worth the hassle in the end. Good luck.

The obvious question then is why ask on here, if like me the majority of people have less knowledge than you?

I think I've been lucky with the bikes I've owned that none have been too much of a problem.

The main thing is that people like yourself are good enough to share your experiences in order to help anyone that does have problems.

It does seem strange that a perceived upmarket manufacturer has so many apparent quality control issues.
 
Look it up on the inter web, plenty out there about it. Search rejecting a car, as more articles relating to cars. There are various periods. 30 days you can reject out of hand for a full refund, up to 6 months mileage, fair wear and tear has to be taken into account. I recently rejected a bike successfully, just inside 6 months, not a BMW I hasten to add.

So it looks like a 'see you in court' situation then?

What exactly do you want ?
 
I also think you have very small chances. At best you may hopefully arrive at a p/x point with another bike that would go far enough to satisfy you. Your money back (what money, new value as of 2years ago? ) you have zero chances I feel.

No offence and I'm not having a pop at the WC riders , but feck the issues seem many and common place.
 
rejected mine after 18ths and 12k miles, but im sure it was funded by the dealer to keep me quiet..it worked :D the new replacement even had keyless and gsap

if it was another brand you wouldn't get another bike, if they put the rejected bike into a closed auction BMW would get there money back almost as its 80% chinese.. peanuts to build :D

Most people don't part with the money Captain! They part with little money with a PCP. Accept the 2k cost of finance over 3years instead of having to worry about stuff... Rust, shocks whatever. It breaks? BMW you own it... Can I have another one?

The only common sensical reasons I can speculate for outright owning a Bmw today is:

One is either tightfisted in money terms and they hate paying financing costs (which bears the question of how come are they then willing to take the quality risks)

And the other reason is a certain satisfaction (that I agree it exists) of having something "fully yours" as in "not borrowed". Like a wristwatch passed from family etc.

Personally, I feel in today's ultra high tech world, owning toys such as expensive bikes, Porsches etc, is just daft and potentially very very very expensive.

My "new toy" feel good factor also lasts about 3weeks in my case so again, the ability to chuck it back to its maker within a year or 2 and get a new on is also much more economic when you don't own.

Eh? Why is it tightfisted to buy a bike outright and avoid paying financing costs? If you can afford to buy a bike outright it's the logical thing to do when financing costs are 5-8% and money in the bank is only getting 1-2%. To take out finance when you don't need to is idiotic.
