Price of the bike isn’t really a consideration as batteries are the same regardless of the bike price generally. It’s just rating that will alter. It’s probably a yuasa which is as good as any. Just a bad one which happens across all marques.

Under the sale of goods act, you are entitled to compensation as the vehicle was not fit for purpose as delivered.
An email explaining the facts, and time of delay for the bikes return, asking for compensation. An email is easily transferred to BMW Customer Services.
But don't accept no for an answer and certainly refuse a KTM as recompense.
ps. I have some previous. I rejected a £250k car that failed as I drove it away from the garage on day one! The law is on the consumer's side especially if you establish the vehicle was not fit for purpose.

I don't think it is worth replying to this thread but to the OP. There is a rant section on the forum to get it off your chest, if you know where to find it. And you should have done some research on the make of bike you chose to buy - BMW - 2nd only to HD for being unreliable (if only Laverda made bikes it would be 3rd). And last but not least, this is a technical section. Ranting in here about crap is not a technical contribution.
